Adopt Resolution 12-21 to rescind Resolution 86-32 Vista Grande Septic Moratorium. effective immediately.
Background:
In practice, Resolution 86-32 has not been enforced for some time now but was never presented formally to the Board of Supervisors to rescind. The proposed language to rescind follows:
WHEREAS, pursuant to Arizona Revised Statues, Title 36, Section 136(D), the Cochise County Health Department has been delegated authority to issue discharge authorizations for conventional septic tank systems and;
WHEREAS, on April 14, 1986 the Cochise County Board of Supervisors passed resolution 86-32 prohibiting conventional septic tank systems in the area known as Vista Grande subdivision due the feeling that the soils in the area are not suitable for conventional septic systems,
WHEREAS, on November 12, 2005 the Arizona Administrative Code, Aquifer Protection Permit Program, Title 18, Chapter 9, Articles 1 thru 4 became effective and set strict standards for septic system design and site evaluations;
WHEREAS, due to the current prescriptive standards and State of Arizona approved trainings, resolution 86-32 is no longer needed,
WHEREAS, the Cochise County Health Department has the oversight, expertise and ability, to evaluate and approve conventional septic systems on a case-by-case basis,
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby rescinds resolution 86-32, effective immediately.
