Approve Third Amendment to Intergovernmental Agreement with the Arizona Counties Insurance Pool for renewal of insurance and insurance services relating to exposure for property, fidelity, employment, employer liability, workers’ compensation, liability losses and other losses as may be permitted by law.

Background:

This revised agreement replaces separate agreements for property and casualty coverage and workers compensation coverage into one agreement, combining the two insurance pools. This Third Amended Intergovernmental Agreement is intended to take effect July 1, upon approval by all member counties, and to remain in effect for a term of 10 years. It does not change the substance of prior agreements, although it does now contain new provisions authorizing the ACIP Board of Trustees to expel a member on a two thirds vote, and raises the ACIP’s unilateral authority to settle claims referred to it from $15,000 to $50,000.

Fiscal Impact & Funding Sources: No immediate fiscal impact.

Department's Next Steps (if approved):

Upon approval and signing of this IGA, it will be forwarded to ACIP for adoption.

Impact of NOT Approving/Alternatives:

The County would be self-insured without benefit of an insurance pool to draw from, or a pre-arranged system for referral of claims for representation by outside counsel, with respect to all liability and workmen’s compensation claims.
