Adopt Resolution 24-23 authorizing the abandonment of a portion of the 50' wide public right-of-way known as Sonni Lane located in the Hereford area.
Background:
This department received an application from Susan Rae Thatcher, owner of APN 105-39-043, to abandon a portion of the 50' wide dedicated right-of-way known as Sonni Lane. She is planning to fence her current property and would like to include the 25’ portion of Sonni Lane adjacent to her. Sonni Lane was conveyed to the public per docket 902 at page 459, as filed in the office of the Cochise County Recorder. The proposed portion of Sonni Lane to abandon is bounded on the north by the southerly right-of-way line of Astro Street and bounded on the south by the northerly right-of-way line of Pillars Lane and located in Section 1 of Township 23 South, Range 20 East of the Gila and Salt River Meridian, Cochise County, Arizona. The southernly portion of Sunny Lane was abandoned by Resolution 08-61 in 2008.
A review of the criteria for the abandonment was conducted as follows:

- The dedicated right of way known as Sonni Lane is not on a section or mid-section line and does not provide sole legal access to any current parcel.
- The adjacent landowners are all in favor of the proposed abandonment.
- The Planning Division Manager has no objections to the abandonment.
- The Fry Fire Department Chief has no issue with the abandonment.
- A site review of the proposed abandonment confirmed that Sonni Lane is not open for use and is currently native desert.
- The Land Purchase Fee is determined by acre. The abandonment size is 0.69 acres at $25,760 per acre, which is equal to $17,748.64. Discount for degree of fragmentation/marketability is 50%. The total of the Land Purchase Fees is $8,874.32, rounded to $8,850.00. The Fees have been received.
Department's Next Steps (if approved):
If the abandonment is approved, no further Board action is required. Upon recording of the resolution and quit claim deeds, staff will forward copies to the applicant and adjacent owners.

If the abandonment is not approved, the public right-of-way will remain public.
