Adopt Resolution 24-30 authorizing the abandonment of a portion of the 60 foot wide public right-of-way known as Calle 14 of the Record of Survey titled Rio Vista Book 1 of Surveys, pages 67-67K. 

Background:

The Right of Way department received an application request to abandon the 60’ public right of way known as Calle 14 from Jennifer and Wilton Deets. They own 6 parcels, an estimated 257 acres, west of Bisbee in the area known as Rio Vista. The abandonment would enable them to combine their parcels into one. The record of Survey Book 1 Pages 67-67K had named easements for ingress and egress. The easements were then dedicated to Cochise County with the recorded deed Docket 1212 Pages 188-228. The 60-foot road known as Calle 14 has not been constructed or used as a roadway, it traverses a mountainous area and is native desert land. A review of the criteria for the abandonment was conducted as follows:
  • The 60’ dedicated right of way known as Calle 14 is not on a section or mid-section line and does not provide sole legal access to any current parcel. The Deets are currently using a recorded easement on parcel 103-37-009 for ingress and egress, and the Greens have a recorded easement on their parcel 103-37-013C for ingress and egress.
  • The adjacent landowners are all in favor of the proposed abandonment.
  • The Cochise County Planning Director has no objections to the abandonment.
  • A site review of the proposed abandonment confirmed that Calle 14 is not open for use and is currently native desert that traverses a mountainous area.
  • Compensation for the proposed abandonment was determined at the minimum value of $2,050 and that amount has been received.

Department's Next Steps (if approved):

If abandoned, and once abandonment documents have been executed, no further Board action is required. Upon recording of the resolution and quit claim deeds, staff will forward copies to the applicant and adjacent property owners.  
 

Impact of NOT Approving/Alternatives:

If the abandonment is not approved, the unused portion of Calle 14 will remain a public right-of-way.
