Adopt Resolution 12-19 dissolving the establishment of the Sunsites Community Park Maintenance District and thereby rescinding Resolution 11-51.
Background:
The Sunsites Community Park Maintenance District was established by the Cochise County Board of Supervisors by Resolution 11-51, passed on November 15, 2011. The resolution was vacated as contrary to law by decision of the Cochise County Superior Court issued May 29, 2012, in the case of Sunsites Concerned Citizens, et al. v. Cochise County, et al., Case No. CV201101157. The Court remanded the matter to the Board “for its dismissal of the formation process for Sunsites Community Park Maintenance District or any other action it deems legally appropriate.”
