Approve Delegation Agreement EV24-0014 between Arizona Department of Environmental Quality and Cochise Health & Social Services Environmental Health Division with expiration year of 2050.
 

Background:

The Environmental Health Division of Cochise Health and Social Services is the entity which carries out environmental health inspections for the State in Cochise County under the authority delegated to Cochise County by ADEQ (Arizona Department of Environmental Quality). Selected delegated functions from the State to Cochise County are conventional and selected alternative on-site wastewater treatment facilities, application review, inspection and issuance or denial of construction authorizations and discharge authorizations.  Also delegated is complaint and compliance assistance response to individual gray-water systems, and the authority to collect fees that are established by the BOS.

Impact of NOT Approving/Alternatives:

Not approving this Delegation Agreement will leave ADEQ without a local agent in Cochise County to whom it can delegate its duties and authorities under ARS 36-182. The State requires the County's assistance in this regard. Additionally, without this delegation agreement local approval and inspections of on-site wastewater would revert to the State of Arizona and fees would be higher, as well as some general sanitation complaints.
