REQUESTED ACTION:

MOTION TO APPROVE a First Amendment to the Agreement Between the Broward Metropolitan Planning Organization and Keefe McCullough & Co., LLP for Audit Services for $23,500, Bringing the Total Not-To-Exceed Amount to $108,500

WHAT THIS ACTION ACCOMPLISHES:

Approval of this item will amend the current Agreement to include one additional fiscal year (FY) audit, ending June 30, 2022 (“FY 21-22”). These services for one additional year are necessary to maintain consistency due to turnover within the Finance Department and to ensure the integrity of an audit opinion. The current auditor has established knowledge of the Broward MPO/governmental practices and operations. 

SUMMARY EXPLANATION/BACKGROUND:

Federal and State guidelines require MPOs expending $750,000 or more of Federal financial assistance in a fiscal year to have a single audit conducted by an independent certified public accountant for that year. This requirement is in accordance with the Federal Office of Management and Budget 2 Code of Federal Regulations Chapter I, Chapter II, Part 200, et al. Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards; Final Rule; and Florida Statute 215.97 Florida Single Audit Act. 

The MPO's current Agreement with Keefe McCullough for Audit Services expires on August 31, 2022. In order to continue fulfilling the Federal requirement described above, maintain consistency due to staff turnover, and ensure the integrity of an audit opinion, it is necessary to extend the existing Agreement for these services via an amendment.

The proposed First Amendment to the Agreement for Audit Services is included in Attachment 1. The Amendment consists of a one-year extension at a cost of $23,500, bringing the total not-to-exceed amount for this Agreement to $108,500. If it should become necessary for the MPO to request any additional services to either supplement the services described in the RFP (RFP No.17-02) or to perform additional work, the First Amendment provides that such additional work shall be performed at the same hourly rates submitted by the contracted firm. Any additional work shall be procured pursuant to an addendum to the initial Agreement, found in Attachment 2, and in accordance with the MPO Procurement Code.

At the upcoming meeting, staff will be available to address any questions or comments on this item.

MPO STAFF RECOMMENDATION(S):

MPO staff recommends approval of the proposed First Amendment to the Agreement with Keefe McCullough for Audit Services for $23,500, bringing the total not-to-exceed amount to $108,500.
