REQUESTED ACTION:

**MOTION TO APPROVE the First Amended And Restated Interlocal Agreement for the Creation of the Metro Transportation Engineering & Construction Cooperative

WHAT THIS ACTION ACCOMPLISHES:

Approval of the proposed First Amended And Restated Interlocal Agreement (ILA) will allow greater discretion to founding member municipalities in selecting an elected official of the municipality to serve on the Metro Transportation Engineering & Construction Cooperative (MTECC) Board by allowing members of the Broward MPO Board to serve on the MTECC Board. This flexibility is supported by the three MTECC founding member municipalities.

SUMMARY EXPLANATION/BACKGROUND:

The ILA that created MTECC was signed by three founding municipalities -- Pompano Beach, Plantation, and Hollywood -- and approved by the MPO Board on April 14, 2022. The adopted MTECC ILA requires municipalities to select an elected official of the municipality to serve on MTECC Board. As municipalities considered which members were interested in serving and had relevant experience, each in turn identified an existing MPO Board Member. In at least two cases, these elected officials participated in the Mayors' and Elected Officials Transportation Roundtable Subcommittee. This was the group -- hosted by the Broward MPO over a three-year period -- that identified the need and opportunity for the organization that ultimately became MTECC. It seems intuitive that these Members have a vested interest in seeing MTECC become a success. The original ILA, found in Attachment 1, does not allow for Broward MPO Board Members to be MTECC Board Members. The founding municipalities have asked for this restriction to be removed to allow the municipalities full flexibility in selecting the best elected official to serve on the MTECC Board.

For the proposed First Amended and Restated ILA which grants municipalities this desired flexibility in choosing their MTECC Board Members, please see Attachment 2. MPO staff will be available at the upcoming meeting to address questions and comments.

MPO STAFF RECOMMENDATION(S):

MPO staff recommends approval of the proposed First Amended And Restated ILA for the Creation of MTECC.
