TITLE:

Consideration and Approval of Intergovernmental Agreement:  Acceptance of hazardous wastes from residences and small businesses located within Coconino County at the City's Hazardous Products Center.

RECOMMENDED ACTION:

Approve the Intergovernmental Agreement with Coconino County.

Policy Decision or Reason for Action:

Approving the Intergovernmental Agreement (IGA) with Coconino County will allow residents and small businesses located outside City limits but within Coconino County to continue using the City's Hazardous Product Center (HPC) and provide a mechanism to continue invoicing Coconino County for use of the facility by County residents.

Financial Impact:

Coconino County will be invoiced quarterly for their residents' usage of the Hazardous Products Center based on percentage of use - typically 35% to 40% of total usage. The City tracks use of the facility and invoices the County based on their percentage for total disposal costs and supplies (e.g. safety equipment, drums and boxes for packaging, etc.).  In addition, the County is invoiced for a portion of City labor costs for processing and packaging the hazardous wastes.  With this IGA, that percentage is increasing from 5% of total labor costs to 10% which is more proportionate to actual expenditure of City labor. Coconino County was invoiced $31,024 last fiscal year.

Has There Been Previous Council Decision on This:

Yes; previous IGAs with Coconino County for usage of the HPC were approved at the June 3, 2008 and September 21, 2010 City Council meetings.








Options and Alternatives

1. Authorize the Intergovernmental Agreement between the City of Flagstaff and Coconino County.
2. Revise the language of the Intergovernmental Agreement between the City of Flagstaff and Coconino County.
3. Reject the Intergovernmental Agreement with Coconino County; however, this would result in a lack of hazardous waste disposal options for residential and small business hazardous wastes generated in Coconino County and outside of Flagstaff City limits.

Background/History:

The Hazardous Products Center (HPC) opened in October 2002 and hazardous wastes from all Flagstaff and Coconino County residents have been accepted since then. The City invoices the County quarterly based on the percentage of usage by its residents. The City's small business waste acceptance program began in 2007 and County businesses have been allowed to utilize this program since its inception. The City and the County have operated under several Intergovernmental Agreements (IGA) that outline how County residents and small businesses may use the facility and how the County will be invoiced for usage of the facility. This IGA would continue these agreements through November 2014, at which time the IGA will be reviewed and brought back to the City Council for renewal.

Key Considerations:

The HPC is the only viable option for Coconino County residents and small businesses to safely and properly dispose of hazardous wastes. Usage of the facility keeps hazardous wastes from being disposed of in the landfill and from being illegally disposed of to the environment.

The Coconino County Board of Supervisors approved the Intergovernmental Agreement on September 18, 2012.

Expanded Financial Considerations:

Approval of this IGA will continue to provide Coconino County residents and small businesses with a safe option for proper disposal and/or recycling of hazardous wastes until November 2014.

Community Benefits and Considerations:

Hazardous Products Center staff provides regular tours of the facility to educational agencies and interested citizens to promote usage of the facility.

Community Involvement:

1. Authorize the Intergovernmental Agreement between the City of Flagstaff and Coconino County which will continue agreed upon operational and invoicing processes for the use of the Hazardous Products Center by County residents and small businesses until November 2014.
2. Recommend new or different language for the Intergovernmental Agreement with Coconino County; this would require the IGA to go back to the County Board of Supervisors for approval.
3. Reject the Intergovernmental Agreement with Coconino County; however, this would result in a lack of hazardous waste disposal options for residential and small business hazardous wastes generated in Coconino County and outside of Flagstaff City limits.
