TITLE:
Upcoming Zoning Code Amendments resulting from new State legislation
STAFF RECOMMENDED ACTION:
The purpose of this item is to inform and answer questions from the Commission. No action is recommended.
Executive Summary:
The conclusion of fiscal year 2023-2024 saw the passage of several bills requiring amendments to the Zoning Code. The following will be addressed in upcoming amendments:
- State Bill 1162 takes effect January 1, 2025 and requires that municipalities submit an annual report and a Housing Needs Assessment to the Arizona Department of Housing (ADOH). The bill also sets specific timeframes for receiving, reviewing, and approving zoning applications. Data derived from the mandatory reports will inform future City activities in forthcoming fiscal years.
- House Bill 2720 has a January 1, 2025 deadline for implementation. The bill outlines development standards for Accessory Dwelling Units (ADU) and mandates certain municipalities to allow or expand their construction on parcels zoned for single-family homes.
- House Bill 2325 forbids municipalities from prohibiting single-family detached homes to keep up to six fowl in their backyards.
- House Bill 2721 necessitates municipalities to enact ordinances, by or before January 1, 2026, to allow the construction of duplexes, triplexes, fourplexes, and townhomes, as a permitted use, on all lots zoned for single-family residential use.
