TITLE:
Consideration and Approval of Contract: Ratification of Job Order Contract and associated Change Order 1 with Eagle Mountain Construction for a temporary drainage improvement for the total amount of $115,505.72
STAFF RECOMMENDED ACTION:
- Ratify the approval of the JOC contract and associated Change Order 1 to Eagle Mountain Construction for a drainage improvement project along Phoenix Avenue and BNSF for the amount of $115,505.72
- Ratify the authorization of the City Manager to execute the necessary documents.
Executive Summary:
A localized drainage problem was identified in Fall 2025 between the new BNSF maintenance building and the Phoenix Sunshine Mission on the east end of Phoenix Avenue. JE Fuller Hydrology and Geomorphology was contracted by Stormwater to produce a temporary drainage improvement to provide flood relief until the Army Corps Rio de Flag (RDF) Project is constructed. A Job Order Contract (JOC) bid was completed in winter 2026 with Eagle Mountain Construction being selected as the lowest qualified bid and the JOC contract was executed in the amount of $93,360.00. Subsequent Change Order 1 was required and fully executed in August 2026 due to an unanticipated cost of having a BNSF inspector onsite during construction. The change order increased the contract cost to over $115,505.72. Since the change order brought the expenditure to over $100,000, it then required City Council's consent approval. Due to time restraints by BNSF, the change order needed to be executed in order to meet the BNSF deadline and therefore staff is seeking approval ratification of both the contract and subsequent change order for the over $100,000 expenditure.

Background and History:
The east end of Phoenix Avenue has long been part of the larger Southside Neighborhood drainage problem(s). The problem was exacerbated in the past decade by continued re-development in the area as well as localized storms, most notably the 2025 fall storms. Localized flooding has impacted several properties including the Phoenix Sunshine Mission and the new BNSF maintenance building. This temporary pipe and catch basins will relieve localized flooding and can be tied into the future RDF Project if desired.

Policy WR.5.4. Develop any necessary stormwater infrastructure improvements consistent with City of
Flagstaff stormwater master plans or studies as adopted by the City.
Policy WR.5.5. Give preference to regional detention facilities that are designed in conjunction with
smaller low-impact development features, rather than numerous smaller dispersed basins. Encourage
