Consideration and Possible Adoption of Resolution No 2019-17:  A resolution authorizing the execution of an Amendment to the McMillan Mesa Village Development Agreement between MMV Devco, LLC, and the City of Flagstaff related to the development of the McMillan Mesa Village subdivision. (McMillan Mesa Village Amendment to Development Agreement)

Executive Summary:

State law allows the City to enter into development agreements by resolution.  The existing development agreement governs the terms and conditions of the existing McMillan Mesa Village subdivision.  The existing development agreement requires the developer to make certain water storage infrastructure improvements and sewer line improvements.  The City no longer desires the water storage infrastructure improvements and the developer has already completed the required sewer line improvements.  This amendment removes the requirement for water storage infrastructure and confirms the completion of sewer line improvements.

Has There Been Previous Council Decision on This:

In March 2007, the City Council approved the Development Agreement for the mixed use subdivision known as McMillan Mesa Village.  This subdivision is situated within the area comprising the McMillan Mesa Village Specific Plan dated August 14, 1992.

Options and Alternatives:

  1. Approve the Amendment to the McMillan Mesa Village Development Agreement as presented.
  2. Approve the Amendment to the McMillan Mesa Village Development Agreement with additional, modified, or deleted terms.
  3. Remand the Amendment to the McMillan Mesa Village Development Agreement back to staff for additional negotiations with the Owner.
  4. Deny the Amendment to the McMillan Mesa Village Development Agreement.

Background and History:

The McMillan Mesa Village Specific Plan was adopted by Ordinance Number 1779 on December 15, 1992.  The McMillan Mesa Village Specific Plan establishes the type, location, intensity, and character of development, and the required infrastructure for the area.  The plan also shapes development to respond to the physical constraints of the site, coordinates the mix of land use intensities, and provides adequate circulation, open space, recreation, and other public uses and facilities. All development within McMillan Mesa Village must comply with the Development Performance Standards and Design Guidelines of the private CC&Rs, as well as the applicable provisions of the Zoning Code with the more restrictive code governing. 

Water 
A previous Water and Sewer Impact Study was completed for the McMillan Mesa Village subdivision in July 2006 in conjunction with the subdivision of the property.  The McMillan Mesa Village subdivision lies within two water pressure zones served by the City of Flagstaff.  Most of the project is served by the Zone A system and only a small part is served by the Zone B system.  As part of the existing development agreement, the City required the developer to install a looped connection to both pressure zones.  Existing Zone A water infrastructure includes a twelve-inch (12”) diameter waterline tying into the 12” main located at the United States Geological Survey (USGS) facility.  The waterline then loops through the internal project, following the N Gemini Drive alignment, and ultimately connecting back to the Zone A system at the intersection of N Turquoise Drive and E Cedar Avenue.  The Zone B water infrastructure includes a connection to the internal Zone B water lines in N Pine Cliff Drive and N Manzanita Way.  The developer has completed these improvements.
 
As part of the existing DA, the City also required the applicant to construct a water storage tank sized to meet the development’s average daily usage plus two-hour fire flow.  The tank was to be placed at an elevation that would provide adequate pressure for the Zone A system (approximately 7260’) and for the associated water lines.  The applicant was also given the option to use one of the City’s existing tank sites depending upon available space.  The City indicated it may share in the cost of any excess storage tank capacity if this excess capacity is determined to be in the City’s best interest.  The developer did not complete this improvement and the City has determined that the water storage tank is no longer needed.

Because the original development fell under the 800 single-family home usage threshold, there were no water production requirements for this subdivision.  Reclaimed water was not required or provided to the subdivision due to the significant level of infrastructure to provide such.
 
Wastewater
The existing 15” diameter Switzer Canyon trunk line is the connection point for all sewage flows generated by the McMillan Mesa Village subdivision.  The Switzer Canyon sewer collector system gravity flows to the south until it ultimately connected to a 33” RCP interceptor line in Foxglenn Park.  As part of the existing DA, the applicant was required to make an off-site modification to the existing sewer system for the subdivision including the replacement of the 33” sewer line, which connects manholes 23-063 and 23-058, with a 42” pipe.  This reach was approximately 2,237’ feet in length and runs from Foxglenn Park to the intersection of E. Butler Avenue.  These improvements have been completed to the City's satisfaction.
 

Key Considerations:

The proposed DA amendment clarifies that the sewer line improvements in Section 6.2 of the DA have been completed to the City's satisfaction.

With respect to the water storage infrastructure improvements set forth in Section 6.1 of the DA, the City no longer requires these improvements.  As development has progressed in the McMillan Mesa Village subdivision, the City of Flagstaff Water Services Division has determined that the land use and intensity proposed for the subdivision can be served by existing water storage and pipeline infrastructure. There is adequate water storage capacity in pressure Zone A which serves this development and the City does not have matching funds scheduled for water storage tank capacity improvements in the current 10-year Capital Improvement Program. No additional offsite infrastructure improvements to water lines, or water storage tanks are required of this development.
 
The McMillan Mesa Development will comply with the existing public water and sewer infrastructure requirements as set forth in the current City of Flagstaff Engineering Standards.
 

Expanded Options and Alternatives:

Inform
The subject property can be and is adequately served by existing water and sewer infrastructure.  No public hearing or public outreach is required as part of the City Council's review of an amended development agreement.
