Approval of the First Amendment to the June 1, 2010 Interlocal Agreement between St. Lucie County, the Treasure Coast Education, Research and Development Authority (TCERDA) Fort Pierce Utilities Authority (FPUA) and the City of Fort Pierce.

This amendment to the agreement between the FPUA, St. Lucie County, Treasure Coast Education Research Development Authority, and the City outlines the terms of the First Amendment to the June 1, 2010 Interlocal Agreement, which includes conditions for annexation. The County agrees to sign the City's annexation agreement for specified parcels identified in Exhibits "A" and "B" and will not object to their annexation regardless of contiguity. The City will not annex these parcels for at least two years from the date of the First amendment. If the City annexes a parcel within the Research Park, it will not hinder the operation of a Research Park without County consent unless mandated by a State or Federal court or agency. In addition, notices must be in writing and delivered in person or by certified mail.

Staff recommends approval of the Interlocal Agreement.

Staff will proceed as directed by the City Commission.
