SUBJECT:
FPRA Resolution 26-23 Terminating the Commercial Facade Agreement at 2203 Orange Avenue.
SUMMARY:
On March 12, 2024, the FPRA approved a Commercial Façade Improvement Grant in the amount of $15,000 for the property located at 2203 Orange Avenue. The Grant Agreement required the recipient to obtain all necessary permits by September 12, 2024. On November 12, 2024, the FPRA approved a six-month extension, extending the permit deadline to May 12, 2025.
The recipient, failed to obtain the required permits and did not cure the Notice of Default issued on September 12, 2025. In addition, the project was required to be completed and operational by March 12, 2026, which did not occur.
In May 2026, the FPRA received a request from the grantee for an additional extension. In response, staff prepared a Second Amendment to the Grant Agreement, which was presented to the FPRA Board at its June 2026 meeting. During the meeting, the Board had questions for the grantee; however, the grantee was not present to address them. As a result, the item was moved to the July 14, 2026, FPRA Board meeting.
On July 6, 2026, FPRA staff received written notification from the grantee stating that they were no longer pursuing the grant. Therefore, staff recommends termination of the Grant Agreement.
The resolution terminates the Grant Agreement for the Commercial Façade Improvement due to the Recipient's default under the terms and conditions of the Grant Agreement and the grantee's request to withdraw from the grant program. No grant funds shall be paid or disbursed to the Recipient.

FPRA REDEVELOPMENT PLAN GOAL/POLICY

RECOMMENDATION:
Staff recommends terminating the agreement.
ALTERNATIVES:
