SUBJECT:

Agreement between the City of Hawthorne and Government Consulting Partners, Inc. to provide comprehensive SB 90 claim services. 
 

RECOMMENDED MOTION:



Staff recommends that the City Council approve the agreement between the City of Hawthorne and Government Consulting Partners, Inc. to provide comprehensive SB 90 claim services for five fiscal years beginning July 1, 2026.

DISCUSSION:

The California constitution requires the State to reimburse local agencies for the cost of mandated programs.  These programs currently cover Police related activity reporting.  In the past, this has also included Public Records Request tracking.  SB 90 is a tool for local governments to request that the State appropriate funds for legislation that contains mandated costs.  If the State Legislature imposes a mandate containing an appropriation, the State Controller is required to process and pay local agencies’ reimbursement claims.  In the event a mandate is passed with no appropriation, local agencies may pursue their reimbursement rights through the Commission on State Mandates. GCP will prepare and file all applicable annual claims and will include any new or first time claims for State Controller claiming instructions that are issued during the contract period.  They will complete all aspects of the annual claims, and new or initial claims released by the State Controller for 5 Fiscal Years for a total not to exceed $38,575.  

In 24-25 the City received $228,478, and in 23-24 revenue was over $316,000.  The reimbursements received represent unrestricted General Fund revenue.

GCP's experience also extends well beyond routine annual claims. The firm supports agencies during desk reviews and field audits, advises on incorrect reduction claims and test claims when needed, and actively monitors Commission on State Mandates activity so clients can begin tracking eligible costs before formal claiming instructions are released.

FISCAL IMPACT:

The amount of $7,200 for SB90 claim services to be performed has been appropriated in the FY 2026-27 annual budget in the General Fund.
