The UCP is requesting a Waiver of Real Property Filing Fees as allowed by Texas Local Government Code, Section 118.0135(a) for the Owner-Occupied Housing Rehabilitation Program and the Homebuyer Assistance Program.
BACKGROUND
As per Texas Local Government Code, Sec. 118.0135. WAIVER OF REAL PROPERTY FILING FEES
(a) The commissioners’ court may direct the county clerk to waive fees for the filing of real property records under this subchapter for a person who is buying or improving the person’s home with assistance from a federal or state grant or aid program that promotes home ownership or home improvement for persons of low or moderate income
(b) The commissioners' court shall specify the types of grant or aid programs that qualify a person for a fee waiver un this section and may limit the waiver to only certain programs.
The Urban County Program (UCP) Owner-Occupied Rehabilitation Program assists low to moderate income persons with home improvements. The Homebuyer Assistance Program was used as a tool by families to assist them in paying closing cost and/or down payment when purchasing a home. Both of these programs are funded by the U.S. Department of Housing and Community Development. Over the past 5 years a total of $74,533 has been paid by UCP to the County on behalf of families receiving assistance through the Owner-Occupied Housing Rehabilitation Program and the Homebuyer Assistance Program for the recording of real property legal documents. Furthermore, over the past 5 years, the cumulative amount of County taxes generated by the assisted units, totals approximately $270,100.00. The UCP respectfully submits that this waiver is justifiable due to the amount of taxes generated for the County as a result of these two assistance program.
