CAPTION

A. Requesting exemption from competitive bidding requirements, under Texas Local Government Code, Chapter 262.024(a)(2) to preserve or protect the public health or safety of the residents of the county and Texas Administration Code, Chapter 273.1, Health services;

B. Requesting authority to enter into a three-month agreement with Correct Rx (current vendor) under the same rates, terms and conditions to have no lapse in service while procurement process is completed and awarded by Purchasing Solutions Alliance Cooperative and subject to final legal review as to form and receiving of Form 1295. 

BACKGROUND

Short term contract is required because PSA is in the process of procuring and awarding the contract for pharmaceuticals to a vendor. Correct Rx is the current awarded vendor, and their contract expires on 12/31/2021; the county is currently using the Coop's contract with CorrectRx, therefore it will expire for the county too. The exemption is needed to allow time for the Coop to award a new vendor without having a lapse in service for the county.
