Authorization and approval to accept the Memorandum of Understanding between the Hidalgo County HIDTA Task Force and the Hidalgo County Constables Office Precinct 3 as set forth under Texas Code of Criminal Procedure Chapter 59.
BACKGROUND
As set forth under the Texas Code of Criminal Procedure Chapter 59 Article 59.06(b) Disposition of Forfeited Property "If a local agreement exists between the attorney representing the state and law enforcement agencies, the attorney representing the state may transfer the property to law enforcement agencies to maintain, repair, use, and operate the property for official purposes if the property is free of any interest of an interest holder."
Memo of Understanding has been reviewed and approved by Legal Counsel.

BUDGETARY IMPACT:
The Constable Pct. 3 Dept may incur costs associated with maintaining forfeiture assets received by the HIDTA Dept. Refer to attached expense report as of 8-21-08 for funds availability.The Law Enforcement agency receiving forfeiture assets under CCP 59 is responsible for maintaining such assets and is responsible for all costs associated with the assets received.
The Constable Pct. 3 office shall return the forfeiture assets when no longer needed to the HIDTA Dept as set forth in the Memo of Understanding.
