BACKGROUND

As set forth under the Texas Code of Criminal Procedure Chapter 59 Article 59.06(b) Disposition of Forfeited Property"If a local agreement exists between the attorney representing the state and law enforcement agencies, the attorney representing that state may transfer the property to law enforcement agencies to maintain, repair, use, and operate the property for official purposes if the property is free of any interest of any interest holder.

BUDGETARY IMPACT:

No fiscal impact to Co. In accordance with CCP 59 the transferred assets shall only be used for law enforcement purposes. The law enforcement agency receiving the assets shall be responsible for all costs associated with the assets received in accordance with interlocal agreements.
