Discussion, consideration and approval for FLSA Exempt, Constable Precinct 4 Chief Deputy Constable employee(s) to participate and receive cash payment for overtime hours worked in Operation BorderStar and Operation Stonegarden grant funded operations, fiscal year 2012. Action to be limited to the grantor agency/institution providing Hidalgo County 100% reimbursement of overtime salaries/ wages and applicable fringe benefits as set forth on grant specifications.

BACKGROUND
Governor's Office will reimburse overtime earned at 100% for Chief Deputy Constables and Deputy Constables
04-24-12 CC approved that all constables could apply for grant (AI32003)
09-11-12 CC approved grant awards for Constable Pct. 4 (AI33920)
Hidalgo County Constable Precinct 4 was awarded $40,000
Grant is for the period of July 6, 2012 to January 31, 2013.
***As per per email from Chief Deputy Joel Rivera, a verbal legal opinion was expressed to Constable Guerra by Mr. Steve Crane.
***As per a telephone conversation on 10/11/12 at 3:24 pm between Budget Analyst Rosie Cantu & Chief Rivera, a written opinion will be requested from Atlas & Hall as soon as possible.
