Discussion, consideration and approval of temporary increases in the records archive fee and the records management and preservation fee in the amount of $10 per applicable filing, in accordance with HB 1513. In accordance with Subchapter D, Chapter 51 of the Texas Government Code, the district clerk office further requests approval of the updated Preservation and Restoration Plan, which the clerk under a county that adopts a fee under this section is required to prepare.
BACKGROUND
HB 1513 allows for temporary increases in the records archive fees and the records management and preservation fees charged by the district clerk for enhanced record management efforts, including the restoration and preservation of archived records. The new legislation provides for a fee not to exceed $10 to be imposed for filing of a suit, including an appeal from an inferior court, or a cross-action, counterclaim, intervention, contempt action, motion for new trial, or third-party petition, in a district court in the county. The district clerk under a county that adopts a fee under this section is required to prepare an annual written plan for the preservation and restoration of district court records archive, attached for the commission's review.
