SUBJECT: PUEBLO VERDE STORAGE DEVELOPMENT - WALL EASEMENT AGREEMENT

SUMMARY

City to consider entering into a wall easement agreement with Goodyear Sarival SS, LLC., an Arizona limited liability company to allow for a zero-setback wall easement, wherein the east wall of Storage Building B will serve as the west wall for the City Fire Station 184 located at Yuma Road.
 

Recommendation

Approve and provide direction to the City Manager to enter into the City of Goodyear and Goodyear Sarival SS, LLC Building B East Wall Easement Agreement. (Linda Beals, Real Estate Coordinator)
 

FISCAL IMPACT

There will be no fiscal impact to the City in the fiscal year 2022 or in future years created by the City entering into this easement agreement.
 

BACKGROUND AND PREVIOUS ACTIONS

On or about April 26, 2021, Council approved a Special Use Permit (20-350-00001) for the Pueblo Verde Storage facility.   This Special Use Permit included a number of stipulations specific to the Fire Station 184 westside wall.   These stipulations require the Goodyear Fire Chief, and/or his designee to approve the proposed site plan and construction plans for the west side wall for Fire Station 184.   The stipulations also require the City Council’s approval of all agreement(s) and/or easements to ensure the aesthetics, safety, integrity, security, and ongoing operations of the Fire Station 184 site and provide an outline of the items to be included in any easement agreement pertaining to the Fire Station 184 west side wall replacement.  
 
On or about May 5, 2021, the City approved the Conceptual Overall Site Plan for the Pueblo Verde Storage facility.   This site plan reflects the zero-setback wall (Building B) along the east side of the Pueblo Verde Storage facility property, adjacent to the west property boundary for Fire Station 184.  

 

STAFF ANALYSIS

City staff has worked with the developer of the Pueblo Verde Storage facility to draft the attached easement agreement, as required to meet the terms of their Special Use Permit approved in April of 2021.  The terms of this agreement include protections for the Fire Station 184 site, including a requirement to coordinate activities with the commanding Fire Department Officer at Fire Station 184; as well as, provisions for security and safety, financial security, and indemnity and liability.
