SUMMARY
The applicant is requesting a recommendation of approval for a New Series 12 (Restaurant) Liquor License.
Recommendation
Recommend approval to the Arizona Department of Liquor Licenses and Control of Application No.181561 a request by Timothy Vasquez, agent/applicant for SOMEBURROS GOODYEAR, LLC., for a new Series 12 liquor license for SOMEBURROS, located at 50 N. Estrella Parkway, Goodyear, Arizona 85338 (Generally located south of Van Buren on the Westside of Estrella Parkway.) (Darcie McCracken, City Clerk)
FISCAL IMPACT
The applicant paid the $635 application fee for the liquor license per the Goodyear Municipal User Fee Schedule. The business will contribute to the tax base of the community.
BACKGROUND AND PREVIOUS ACTIONS
Mr. Vasquez has applied for a new Series 12 liquor license for SOMEBURROS, which is currently under construction with an anticipated opening date in March 2022. SOMEBURROS will be a full-service restaurant and is the 13th location in the Phoenix Metro Area, with other restaurants located in Tempe, Chandler, Gilbert, Mesa, Scottsdale, Flagstaff, Queen Creek, and Phoenix.
The City Clerk's Office received the application from the DLLC on January 27, 2022. The applicant paid the $635 application fee for the liquor license, and a public hearing notice was immediately posted on the property through FASTSIGNS International, Inc. on February 7, 2022, to comply with the State-mandated comment period. No petitions or protests from qualified persons were received during the comment period.
The application was routed to the Police Department and the Development Services Department (Planning and Zoning, Code Compliance, and Building Safety), and any comments from these departments are listed below:

STAFF ANALYSIS
A Series 12 license is for a restaurant and is non-transferrable. This on-sale retail privileges liquor license allows the holder to sell and serve all types of spirituous liquor solely for consumption on the premises of an establishment that derives at least forty percent (40%) of its gross revenue from the sale of food.
The DLLC requires license owners, agents, and managers actively involved in the day-to-day operations of the business to complete a state-approved management training course prior to the issuance of a liquor license. Mr. Vasquez states that the front-end employees have completed the required training. A manager will be present on-site during all business hours, and they will take the following steps to prevent the sale of alcohol to minors:
1. Post signs that indicate the legal drinking age and that they will card anyone who appears to be under 40 years old.
2. Ensure all staff is trained to understand and follow the guidelines of Arizona liquor license laws.
There are no licensed childcare facilities, K-12 schools or churches within 300 feet of the location.
The City Council's recommendation of "Approval", "Disapproval" or "No Recommendation" will be forwarded to the DLLC for consideration during their licensing review process.
