SUMMARY
A Final Plat combining two lots into one new lot approximately 20.225 gross acres and 19.758 net acres in size, near the intersection of MC-85 and Atlanta Avenue .

RECOMMENDATION
Approve the Final Plat for Bungalows at Lakin Park, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)
STIPULATIONS
1. Except as otherwise approved in writing by the City Engineer or his designee, no work shall commence within the right-of-way dedicated to the city in the Final Plat for Bungalows at Lakin Park until Maricopa County accepts ownership of the right-of-way and approves the deannexation of this right-of-way.
2. Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat; and
3. Prior to recordation of the Final Plat, Owner shall submit an updated title report for the property included within the boundaries of the Final Plat (the “Platted Property’) and shall modify the Final Plat to reflect the current ownership and current lender including on Final Plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the Platted Property. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing the Final Plat is authorized to do so.

FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
Approximately 15.4 acres within the subject property (“the Property”) were included in the 695.6-acre CP Lakin Park rezone, which was approved by City Council on October 28, 2019, under Ordinance 2019-1451. Per that action, the zoning of these 15.4 acres was changed from Agricultural Urban (AU) to PAD with underlying Multi-Family (MF-24). The remaining land within the Property (approximately five acres) was omitted from the Lakin Park PAD and retained its original AU zoning.
On September 27, 2021, City Council approved a rezone for the entire Property from a combination of AU and PAD with underlying MF-24 zoning, to MF-24 with a PAD Overlay.
On May 17, 2023, staff administratively approved a site plan for a multi-family development of 218 for-rent bungalows, to be known as Bungalows at Lakin Park. The site plan approval included a stipulation requiring the submittal of a final plat to combine the two lots comprising the Property into one new lot.
On September 27, 2021, City Council approved a rezone for the entire Property from a combination of AU and PAD with underlying MF-24 zoning, to MF-24 with a PAD Overlay.
On May 17, 2023, staff administratively approved a site plan for a multi-family development of 218 for-rent bungalows, to be known as Bungalows at Lakin Park. The site plan approval included a stipulation requiring the submittal of a final plat to combine the two lots comprising the Property into one new lot.
STAFF ANALYSIS
The proposed lot combination is consistent with the General Plan and staff has determined that the development of the site, as reflected in the site plan that is precipitating the combination of the two existing lots, will not adversely impact the surrounding area. Further, the proposed lot combination is consistent with the technical requirements of the city’s subdivision regulations and engineering standards and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
Because the property included within the final plat is adjacent to MC-85, Maricopa County is requiring the construction of additional improvements to provide access into the property. The final plat provides for the dedication of additional right of way required by the city. Because the right-of-way being dedicated is located within the city, but is needed for county road improvements, the city is conditioning the construction of improvements required by the county upon Maricopa County’s Board of Supervisors approval of the de-annexation of the right of way so that all of MC-85 is located within the Maricopa County. If the county does not accept ownership of the right-of-way and approve the de-annexation, the City will vacate the right-of-way as it is not needed for the city’s street system.
