SUBJECT: APPROVAL OF MEMORANDUM OF UNDERSTANDING (MOU) WITH FEDERAL BUREAU OF INVESTIGATION (FBI) FINANCIAL CRIMES TASK FORCE

SUMMARY

This Memorandum of Understanding (MOU) between the city of Goodyear and the Federal Bureau of Investigation (FBI) allows for the Goodyear Police Department's first time participation with the Financial Crimes Task Force (FCTF).

RECOMMENDATION

Approve the MOU with the Federal Bureau of Investigation to allow the Goodyear Police Department to participate in the Financial Crimes Task Force, and provide authorization and direction to the City Manager, or designee, to take action and execute documents necessary to carry out the intent of the agreement. FISCAL IMPACT

The Police Department's current Fiscal Year (FY) 2027 base budget covers the Property Crimes Unit detective's position that would participate part-time in the FBI Financial Crimes Task Force.

BACKGROUND AND PREVIOUS ACTIONS

The cooperation between federal and local task force agencies began in the 1970s. The FBI Financial Crimes Phoenix Task Force consists of federal agents and local law enforcement task force officers. The purpose of the task force is to disrupt cyber-related fraud crimes in the state of Arizona. Assigned task force members gather intelligence concerning cyber-related crimes, conduct undercover operations, and assist as necessary with the prosecution of criminal defendants and illicit criminal organizations.

STAFF ANALYSIS

The mission of the FCTF is to identify, and target for prosecution, organized groups and individuals involved in federal/state/and local financial crimes to include cyber-related fraud such as wire fraud, mail fraud, bank fraud, bankruptcy fraud, credit card fraud, identity theft, money laundering, mortgage fraud, bank fraud, securities and commodities fraud, cyber-enabled fraud, money laundering, and criminal violations of intellectual property rights. The FCTF will enhance the effectiveness of federal/state/local law enforcement resources through a well-coordinated initiative seeking the most effective investigative/prosecutorial avenues by which to investigate, convict and incarcerate those involved.

The FCTF provides access to federal resources the City of Goodyear Police Department currently does not have to assist in Financial Crimes investigations such as crimes related to cryptocurrency, gold and other precious metals. Additionally, the FCTF provides partnering agencies the opportunity to de-conflict cases and enhance collaboration in dealing with complex money trails and identity theft investigations.  

It has been determined that participation in the FCTF will assist the department in investigating fraud cases which benefit the City of Goodyear. The MOU is included as Attachment A.
