SUMMARY
Acceptance of a Special Warranty Deed from W/C Lakin Owner VIII, L.L.C., a Delaware limited liability company for the lift station site required for the Lakin Park Development.
Recommendation
Accept the Special Warranty Deed for the Lakin Lift Station from W/C Lakin Owner VIII, L.L.C., a Delaware limited liability company. (Linda Beals, Real Estate Coordinator)
FISCAL IMPACT
There will be no fiscal impact to the City in the fiscal year 2021 of future years with the acceptance of this special warranty deed.
BACKGROUND AND PREVIOUS ACTIONS
W/C Lakin Owner VIII, L.L.C., a Delaware limited liability company “Lakin” is owner of the Lakin Park development. Lakin is in the process of developing Phase 1 of Lakin Park which consists of an approximate 85 acre industrial site located at the southwest corner of MC-85 and Cotton Lane. A Minor Land Division for Lakin Park – Phase 1, which includes a 0.37 acre site for a wastewater lift station, was administratively approved and recorded in the official records of Maricopa County at Book 1588 page 30, instrument number 2021 0480315 on April 29, 2021.
Lakin is responsible for the design and construction of infrastructure required for the city to serve Lakin Park, including a wastewater lift station within Tract A of the Minor Land Division for Lakin Park – Phase 1. Lakin has provided the attached Special Warranty Deed to convey the lift station site to the City.STAFF ANALYSIS
The construction of the wastewater lift station is a critical component of the Lakin Park infrastructure. The City has reviewed the construction plans and has required the lift station site be dedicated to the City as part of the construction permitting process.
