Grant an Easement to Maricopa County Water Conservation District Number One (MWD) required for relocated MWD facilities, which will be relocated to facilitate the development of the PHX70 property.

There is no fiscal impact to the City as a result of the granting this Easement in FY23 or any future year.

The development of the property known as PHX70 required the relocation of existing MWD facilities. The owner of the property will relocate the facilities. A section of the MWD facilities consists of underground piping that has been or will be located under Osborn Road, which is right-of-way owned by the City of Goodyear. MWD requires an easement within the section of Osborn Road where the MWD facilities will be or are located (the “Easement Area”).

The terms of the easement requested by MWD is consistent with the rights it had for the MWD facilities that had to be relocated. The Easement grants MWD the right to locate the same types of facilities within the Easement Area as MWD had for the relocated facilities, and it grants MWD prior rights, which require the city to bear the costs associated with any modification or relocation of the MWD facilities installed within the Easement Area. Staff is recommending council authorize the City Manager to execute an Easement granting Maricopa County Water Conservation District Number One an easement for MWD facilities.
