SUMMARY
A Final Plat subdividing approximately 24 acres into 6 lots at the northeast corner of Estrella Parkway and Roosevelt Street
Recommendation
Approve the Final Plat of Estrella Commons District attached hereto, subject to stipulations. (Marty Crossland, Interim Deputy Director of Development Engineering)
STIPULATIONS
- Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat;
- Prior to recordation of the final plat, Owner shall submit a current title report for the Property and shall modify this plat to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so; and
- Prior to recordation of the final plat, a Public Utility and Sidewalk Easement within the property owned by Cyrene at Estrella HOA adjacent to the southside of Roosevelt Street in the location required by the City Engineer or his designee and in a form approved by the City Attorney or his designee shall be conveyed to the City and recorded in the official records of the Maricopa County Recorder; and
- Prior to recordation of the final plat, additional property owned by Cyrene at Estrella HOA adjacent to the southside of Roosevelt Street shall be conveyed to the City for right-of-way by the Special Warranty Deed approved by separate action and the Special Warranty Deed conveying such right-of-way shall be recorded in the official records of the Maricopa County Recorder; and
- Prior to recordation of the final plat, a Public Utility and Sidewalk Easement within the property owned by Aldi Arizona L.L.C. adjacent to the southside of Roosevelt Street in the location required by the City Engineer or his designee and in a form approved by the City Attorney shall be conveyed to the City and recorded in the official records of the Maricopa County Recorder; and
- Prior to recordation of the final plat, additional property owned by the Aldi Arizona L.L.C. adjacent to the southside of Roosevelt Street shall be conveyed to the City for right-of-way by the Special Warranty Deed approved by separate action and the Special Warranty Deed conveying such right-of-way shall be recorded in the official records of the Maricopa County Recorder; and
- Owner shall construct all on-site and off-site infrastructure improvements required: (i) for the City to provide utility services to the Property; (ii) by applicable Development Regulations, including by way of example, the City of Goodyear subdivision regulations, the City of Goodyear Engineering Design Standards and Policies, and all adopted Building codes; (iii) identified in the NEC Estrella Parkway and Roosevelt Street, Goodyear, Arizona – Traffic Impact Statement; approved by the City Engineer or his designee on 12/9/2021, a copy of which is on file with city; and (iv) required by any of the stipulations set forth in Ordinance 2021-1509; and
- Owner shall dedicate or cause the dedication, at no cost to the City, all easements and right-of-way needed for construction of all on-site and/or offsite infrastructure Owner is required to construct pursuant to stipulation 7 above. The conveyances required herein shall be lien free and free of all encumbrances except as agreed to by the City Engineer or his designee.
- Owner/Developer shall construct, at no cost to the City, the remainder of the full half-street improvements required for a Scenic Arterial as set forth in the Engineering Design Standards and Policies Manual in effect at the time of construction for the section of Estrella Parkway along the western boundary of the Property. This includes, but is not limited to removing the temporary pavement that was installed for the third lane of the east side of Estrella Parkway, and installing pavement for a third lane of the east side of Estrella Parkway, decel lanes, bus bays, bike lanes, curb, gutter, sidewalks, street frontage landscape and landscape irrigation that complies with the requirements set forth in the Engineering Design Standards and Policies Manual (the "Estrella Parkway Improvements"). The Estrella Parkway Improvement s shall be completed prior to the issuance of any Certificate of Completion, Temporary Certificate of Occupancy, or Certificate of Occupancy, for any structure within the Property.
FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
The property is currently zoned MF-24 and C-2 under the Estrella Commons District Planned Area Development (PAD) Overlay, which was approved by City Council on July 19, 2021 by Ordinance No. 2021-1509. This final plat is proposing the subdivision of six lots which does not require a Preliminary Plat per the City’s Subdivision Regulations, which is required when a subdivision of more than 10 lots is proposed.
STAFF ANALYSIS
The Final Plat is consistent with the technical requirements of the city's subdivision regulations and engineering standards. The Final Plat is consistent with the land use and development standards approved in the C-2 and MF-24 Zoning Districts as modified by the Estrella Commons District PAD Overlay for the Property. It provides for the orderly development of the property by identifying the required infrastructure needed to serve the development and the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area.
