SUBJECT: PERMANENT EXTENSION OF PREMISES/PATIO PERMIT FOR THE CANTINA AT PRESIDIO

SUMMARY

The applicant is requesting a permanent extension of premises/patio permit to add the existing grass area to the premise map which was not originally included.

Recommendation

Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of a permanent extension of premises/patio permit request for liquor license #14073061, submitted by Julia Holland, Agent for CantaMia at Estrella Association, located at 17700 W. Star Point Dr., Bldg. B, Goodyear, AZ  85338. (Generally located Southwest corner of S. Estrella Pkwy and Tanglewood Dr.). (Darcie McCracken, City Clerk)

FISCAL IMPACT

Per the Goodyear Municipal User Fee Schedule, a liquor license fee is only charged for new liquor licenses and annual renewals. An extension of premises/patio permit application pertains to current liquor licenses; therefore, no fee is charged. This business will continue to contribute to the tax base of the community.

BACKGROUND AND PREVIOUS ACTIONS

The DLLC issued a Series 12 (Restaurant) liquor license to Cantina at Presidio on September 11, 2020.  On July 11, 2022, Council approved a permanent extension of premise to include the existing pool in the site map.

The City Clerk's Office received the current application on September 27, 2022. The applicant proposes to extend the premises covered by the license to include the existing grass area next to the Community Center.

The Police Department, and the Development Services Department (Planning and Zoning, Code Compliance and Building Safety) reviewed the application. Any comments received appear below:

STAFF ANALYSIS

A liquor licensee is required to submit a formal request when they wish to change the physical arrangement of the licensed premises from the diagram on record at the DLLC.

There are no licensed childcare facilities or K-12 schools within 300 feet of the location.

Unlike other liquor license applications, an application for an extension of premises/patio permit must be submitted to the local governing board for approval before submitting to the DLLC. After local approval, the DLLC has 45 days to process the permanent change of premises.

The City Council's recommendation of action, denial or no recommendation will be forwarded to the DLLC for their consideration.
