SUBJECT: FINAL PLAT OF PROLOGIS 303 GOODYEAR

SUMMARY

A final plat subdividing approximately 114.1 acres into 2 lots and 0 tracts at the intersection of N. Cotton Lane and W. Camelback Road.

STRATEGIC PLAN ALIGNMENT

     

RECOMMENDATION

Approve the Final Plat for Prologis 303 Goodyear subdividing approximately 114.1 acres into two (2) lots (the “Property”). (Marty Crossland, Interim Deputy Director of Development Engineering)

STIPULATIONS

1. Any technical corrections to the Final Plat for Prologis 303 Goodyear required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat for Prologis 303 Goodyear; and
2. Prior to recordation of the Final Plat for Prologis 303 Goodyear (the “Final Plat”), Owner shall submit an updated title report for the property included within such final plat (the “Property”) and shall modify the Final Plat to reflect the current ownership and current lender including on the Final Plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in all or part of the Property; and   
3. Prior to recordation of the Final Plat, documentation acceptable to the City Attorney or his/her designee shall be provided demonstrating that the party executing the final plat is authorized to do so; and  
4. Owner is responsible for a proportionate share of the costs of a full (all four legs) traffic signal at the intersection identified below.  Owner shall make an in-lieu payment for the cost of traffic signal adjacent to the Property. The in-lieu payment shall be made prior to the recordation of the first final plat subdividing all or part of the Property or prior to the issuance of any construction permits for work within the Property, whichever is earlier. The in-lieu payment shall be based on the actual cost of the traffic signal if it has been constructed or if the payment is required before the signal is constructed it shall be based on the estimated cost of the traffic signal as determined by the City Engineer or designee.
• 25% of the Full Cost of a Traffic Signal (all four legs) at the Intersection of N. Cotton Lane and W. Minnezona Ave.; and
5. Unless constructed or being constructed by others, Owner shall, at no cost to the City, design and construct full half-street improvements for the west half of the section of N. Cotton Lane along or adjacent to the frontage of the Property required for a Major Arterial as set forth in the Engineering Design Standards in effect when the improvements are constructed (the “Cotton Lane Improvements”). The Cotton Lane Improvements to be constructed include, but are not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting. Except as otherwise provided in a written development agreement approved by Council or a written phasing plan approved by the City Engineer or his designee, the Cotton Lane Improvements shall be completed in connection prior to the issuance of any certificate of occupancy for any building within the Property. If the Cotton Lane Improvements have been constructed or are being constructed by others, Owner shall remit a payment to the city in the amount of the actual costs incurred in the design and construction such infrastructure improvements if completed or, if not completed, the payment shall be in the amount of an engineer’s estimate of the costs as approved by the Goodyear City Engineer or his/her designee. If a payment of the Cotton Lane Improvements is required as provided herein, it shall be paid prior to the issuance of any construction permit for any work within the Property; and
6. In addition to constructing the infrastructure improvements specifically identified herein, Owner shall design and construct, at no cost to the City, all infrastructure improvements identified by the City as being needed to provide water and sewer services to the Property, if the Property is within the City’s service area, and all infrastructure improvements required to be constructed pursuant to any applicable law, code, ordinance, rule, regulations, standards, guidelines governing the development of Property within the City of Goodyear, including, but not limited to the City of Goodyear subdivision regulations, Building Codes and Regulations, and the city of Goodyear’s Engineering Design Standards and Policies; and
7. Prior to recordation of the Final Plat for Prologis 303 Goodyear, the Property owner shall execute an avigation easement over the Property, in a form approved by the City Attorney or designee; record such avigation easement in the Maricopa County Recorder's office and provide the Development Services Director, or his designee, with a copy of the recorded easement.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The Property was rezoned in 2018 from Light Industrial (I-1) and General Commercial (C-2) zoning districts with a Final Planned Area Development (PAD) overlay to allow for a development known as Camelback 303 Commerce Park to the I-1, Light Industrial Park Zoning District by Ordinance 2018-1415 adopted on November 26, 2018 and recorded on November 29, 2018, with Maricopa County Recorder instrument number 20180878064.

STAFF ANALYSIS

The proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
