| SUBJECT: | UNDERGROUND DRAINAGE EASEMENT FOR FLOOD CONTROL PURPOSES TO THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY |

SUMMARY
The Flood Control District has requested an Underground Drainage Easement from the City of Goodyear for the area along W. Van Buren Street, between N. Perryville Road and the Roosevelt Irrigation District (RID) canal.

FISCAL IMPACT
There is no fiscal impact to the City in fiscal year 2024 or future years.
BACKGROUND AND PREVIOUS ACTIONS
The White Tanks FRS # 4 dam, located at the northwest corner of Jackrabbit Trail and Van Buren Street, was originally constructed in 1954 by the U.S. Soil Conversation Service (now the Natural Resources Conservation Service) and is operated and maintained by the Flood Control District. The dam receives stormwater runoff from the southeast side of the White Tanks Mountains, as well as from stormwater facilities located to the north.
The White Tanks FRS # 4 outlet facility project includes a storm drain beginning at the upstream dam, continuing east within the right-of-way of Van Buren Street, and tying into the Loop 303 drainage channel just west of Cotton Lane. City staff approved plans for the project contingent upon Flood Control District obtaining the Underground Drainage Easement for Flood Control Purposes. On April 22, 2019, Council approved an easement authorizing the construction of improvements within a section of the Van Buren Street right-of-way, and the Flood Control District constructed a 78-inch RGRCP storm drain pipe within Van Buren Street right-of-way.
It was later discovered that the easement that was granted did not include the entire section of the Van Buren storm drainpipe constructed, and the city was asked to grant an easement within which the storm drainpipe was constructed starting approximately 241 feet east from Perryville Road and continuing east to the Roosevelt Irrigation Canal just west 181st Avenue is located with the city’s jurisdiction.

STAFF ANALYSIS
The key benefit the city received from the easement previously granted was the ability for the city to tie into the pipeline for the purpose of drain-down of retention basins of adjacent development. The attached easement is consistent with the easement previously granted and provides the same benefit. Staff recommends Council approve the easement attached hereto and authorize its execution.
