SUMMARY

Acceptance of right-of-way for roadway improvements on Citrus Road required for the Abel Ranch Development.

STRATEGIC PLAN ALIGNMENT

     

RECOMMENDATION

1. Authorize the acceptance and execution of a Special Warranty Deed from Citrus Land, Inc., conveying right-of-way needed for roadway improvements on Citrus Road as required by the City of Goodyear for the Abel Ranch Development.

2. Authorize the acceptance and execution of a Special Warranty Deed from Southwest Next NEC Indian School and Citrus, LLC, conveying right-of-way needed for roadway improvements on Citrus Road as required by the City of Goodyear for the Abel Ranch Development. FISCAL IMPACT

There is no fiscal impact to the city by accepting the dedication of right-of-way needed for roadway improvements on Citrus Road. The construction of roadway improvements by the developer will generate one-time revenue for the city through payment of permits and construction sales tax. Upon the acceptance of the roadway improvements by the City Engineer, and subject to the completion of a two-year warranty period, the City will be responsible for maintaining the right-of-way.

BACKGROUND AND PREVIOUS ACTIONS

Meritage Homes is developing a multi-family residential project at the southeast corner of Citrus and Camelback Rd known as “Abel Ranch” that requires access from Citrus Road. To provide access from Citrus Road at the proposed location, Meritage Homes is required to construct a right lane deceleration lane on property owned by Citrus Land, Inc. (parcel 502-31-010) and property owned by Southwest Next NEC Indian School and Citrus, LLC, (parcel 502-31-010A) located south of the Abel Ranch Property. Citrus Land, Inc. and Southwest Next NEC Indian School and Citrus, LLC have agreed to convey the right-of-way needed for the deceleration lane Meritage Homes is required to construct. The right-of-way is being conveyed in fee ownership by special warranty deed consistent with City Property.

STAFF ANALYSIS

The Developer is responsible for constructing the improvements and the City will own and maintain the right-of-way. Citrus Land, Inc. and Southwest Next NEC Indian School and Citrus, LLC have agreed to convey the right-of-way to the city pursuant to the Special Warranty Deeds attached hereto. Council approval is required to accept the conveyance of right-of-way. Staff is recommending acceptance of the Special Warranty Deeds from both property owners granting the right-of-way needed for roadway improvements that the City will own and maintain. The acceptance and execution of the Special Warranty Deeds attached will facilitate the development of the Project.
