SUMMARY
This Intergovernmental Agreement (IGA) between the City of Goodyear and the Town of Guadalupe for Judicial Services, authorizes the Goodyear Municipal Court to maintain jurisdiction of cases from the Guadalupe Town Court, filed prior to July 1, 2020.

FISCAL IMPACT
The City of Goodyear will receive a payment from the Town of Guadalupe in the amount of $20,240 to be deposited in the City of Goodyear Court Enhancement Fund. Goodyear will also receive all future revenues, including but limited to fines, fees, assessments, Judicial Collection Enhancement Fund ("JCEF"), Fill the Gap funds, FARE quarterly disbursements and Court grants for all cases remaining under the maintenance of the Goodyear Municipal Court.
Goodyear anticipates the personnel cost associated with the processing of Guadalupe cases will continue to decrease, as cases continue to be resolved and closed by Goodyear Court personnel. Additionally, nearly all case activity is received via automated case payment processing features, further reducing the level of Goodyear personnel resources dedicated to processing the cases from the Guadalupe Town Court. Anticipated funding projections would cover all expenses until the next evaluation period of the IGA. This funding projection does not include revenues received from quarterly FARE disbursements, which would add to the projected estimation of cost remuneration.

BACKGROUND AND PREVIOUS ACTIONS
This agreement is a renewal to the terms previously established under IGA in 2020, agenda item 2020-7003. Pursuant to the terms of that agreement, this renewal is mutually beneficial to the Town of Guadalupe and the City of Goodyear, and authorizes the continuous provision of Judicial Services.
STAFF ANALYSIS
The initial caseload received in 2020 from the Town of Guadalupe was 610 cases, at a payment of $23,000. At the time of this renewal term, 538 cases remain under the maintenance of the Goodyear Municipal Court. Guadalupe has agreed to remit $20,240 for these cases to be handled over the next 5 years of the IGA term. Cases are post-adjudicated and eligible for automated payment processing on the state website azcourtpay.com which will receipt automatically into the AJACS database. Goodyear Court staff will process case activity in an administrative capacity on a daily basis, based upon the payment activity received. Case typically require staff processing only if the case has reached closure status. Goodyear has also entered all defaulted cases into the statewide Debt Setoff (Tax Interception) program, further increasing payment processing and ensuring cases reach final disposition and closure. The proposed compensation also factors any costs associated with external audits, such as Minimum Accounting Standards Tri-Annual audit to be conducted in 2025.
