RECOMMENDATION
ADOPT ORDINANCE NO. 2024-1611 AMENDING CHAPTER 3 ARTICLE 9, PUBLIC AND PERFORMING ARTS PROGRAM, OF THE GOODYEAR CITY CODE, PROVIDING FOR CORRECTIONS, SEVERABILITY AND AN EFFECTIVE DATE. (Layne Ruiz, Arts & Culture Coordinator)

There is no direct budget impact associated with the approval of this text amendment.
BACKGROUND AND PREVIOUS ACTIONS
The Arts & Culture Commission reviewed and discussed the Arts & Culture Commission Bylaws on Tuesday, January 9, 2024. The Commission identified the need to remove naming the West Valley Art Council Executive Director or designee as the non-voting standing ex officio member due to the inability of the West Valley Arts Council to fill this role. In order to amend the Goodyear Arts and Culture Commission Bylaws, the Ordinance must be amended.
The amendment to Article 3-9 of the City Code was reviewed and discussed at the Council Subcommittee meeting on May 22, 2024. The Subcommittee had consensus to move forward to the full Council with the changes.

STAFF ANALYSIS
The West Valley Art Council ex officio position has not been filled since May 10, 2022, due to restructuring of the Council. During this time, staff has attempted to recruit the Executive Director of designee of the West Valley Arts Council but has remained unsuccessful.
Amending the Public and Performing Arts Ordinance will allow Mayor and Council and the Arts and Culture Commission more authority in naming an ex officio member without being restricted or limited to a specific organization. Additional text amendments include changing “citizen” to “resident” for more inclusive language and reordering text for clarity.
Staff recommends the adoption of Ordinance No. 2024-1611 amending Article 3-9 of the Goodyear City Code.
