SUBJECT: GRANT OF AN AERIAL UTILITY LINE EASEMENT TO APS, OVER A PORTION OF CITY-OWNED PROPERTY AT THE NORTHWEST CORNER OF VAN BUREN STREET AND 143RD AVENUE

SUMMARY

Arizona Public Service Company (“APS”) has requested that the City of Goodyear (“City”) grant to APS an aerial easement to install electrical lines ("Aerial Utility Line Easement") over a portion of City owned property with assessor’s parcel number 500-10-718C (“City Parcel”). The Aerial Utility Line Easement that APS has offered to purchase from the City, is part of their Three Rivers 230kV Transmission Line project to upgrade electric service in the Goodyear area. Construction of the new 230,000-volt electric transmission line will ensure greater reliability of their electrical system and provide for future growth.

RECOMMENDATION

Approve the Aerial Utility Line Easement granting APS an aerial easement above a portion of the City Parcel approximately located at the northwest corner of Van Buren Street & 143rd Avenue and authorize its execution by the City Manager following the City’s receipt of APS’s payment of $6,475. FISCAL IMPACT

APS is compensating the City $6,475 for the Aerial Utility Line Easement that is to be granted. Upon receipt of the funds, the easement will be signed and recorded. Immediately after recording, a copy of the recorded easement will be emailed to the APS representative, and the original easement mailed to APS. It is the sole responsibility of APS to install, operate and maintain their facility at no cost to the City.   

BACKGROUND AND PREVIOUS ACTIONS

The City Parcel is currently used for Goodyear’s Fire Station 181 (the “FS-181”). After consultation with city staff, including the Deputy City Managers, Deputy Director of Development Engineering, City Traffic Engineer, Fire Chief, CIP Manager, City Real Estate Staff, City Legal Staff, APS’s project manager and other APS staff, the City and APS agreed on a solution that limited the impact of the APS easement on the City’s use of the City Parcel for FS-181.  The solution included the electrical transmission lines, and any appurtenances thereto, installed by APS shall not interfere with any traffic signal equipment on or adjacent to the City Parcel or the operation and maintenance of the traffic signals at the intersection of Van Buren Street and 143rd Avenue. Any equipment installed pursuant to the Aerial Utility Line Easement that interferes with the City’s operation of traffic signals at the intersection of Van Buren Street and 143rd Avenue or any traffic signal equipment on or adjacent to the City Parcel or that interferes with the installation, operation, maintenance, repair and replacement of any facilities constructed within the easement premises pursuant to any public utility easement shall be removed or relocated at APS’s expense, so as not to interfere with the traffic signals or any associated equipment or with any other utilities located within the easement premises pursuant to a public utility easement. APS shall not install any equipment, poles, or appurtenances within the easement premises.
 
All electrical transmission lines transmitting electricity of 69kV or less over the easement premises shall be located a minimum of twenty feet (20’) above any traffic signal equipment owned by the City, measured from the tallest point of the City's traffic signal equipment to the lowest point of the Electrical Transmission Lines. Any Electrical Transmission Lines transmitting electricity in excess of 69kV over the Easement Premises shall be located a minimum of fifty feet (50’) above any traffic signal equipment owned by the City, measured from the tallest point of the City’s traffic signal equipment to the lowest point of the electrical transmission lines.

In order to allow the normal operation of FS-181, APS agreed that any installation, maintenance, repair, or replacement of the electrical transmission lines over the easement premises shall be done without street closures that prevent traffic flow on either 143rd Avenue or Van Buren Street.

It is the sole responsibility of APS to install, operate and maintain their facility at no cost to the City.  

STAFF ANALYSIS

Staff is recommending granting of the Aerial Utility Line Easement to APS over a portion of the City Parcel. The granting of the easement will not conflict with the operations of FS-181 or the operations and needs with regards to the City Parcel. Additionally, because of the location of the easement, there is no impact on the land value of the City Parcel. The grant of this easement will facilitate the installation of the APS overhead electric lines, at its sole cost and expense.
