SUMMARY
Dedication of right-of-way for additional parking along N. Civic Square and partial termination of an existing sidewalk easement. To allow for the relocation of a sidewalk located within the right-of-way being dedicated to the City which are needed to support the development of a medical office building on the parcel immediately to the south of City Hall.

RECOMMENDATION
Accept the dedication of the Right-of-Way from Globe Land Investors LLC, approve the Partial Termination and Release of Easement, and authorize the execution of both documents by the City Manager. (Colton Blyle, Real Estate Specialist)
FISCAL IMPACT
There will be no fiscal impact to the City in the fiscal year 2024 or future years related to the issuance of these instruments.
BACKGROUND AND PREVIOUS ACTIONS
Globe Land Investors LLC, owner of the parcel immediately to the south of City Hall (parcel 501-73-982) is constructing a Medical Office Building on the property. The development plans call for the development of on-street parking in the front of the Medical Office Building similar to that in the front of City Hall and the library. The development plan requires the dedication of additional right-of-way, which is being conveyed by the Special Warranty Deed attached hereto, the termination of the portion of the sidewalk easement located within the new right-of-way and the dedication of a new sidewalk easement to allow for the construction of a sidewalk around the new right-of-way to provide a continuous sidewalk. Globe Land Investors LLC has, by separate instrument, dedicated the sidewalk easement needed for the relocated sidewalk, which, pursuant to authority granted the City Manager, has been accepted on behalf of the City.
STAFF ANALYSIS
Engineering staff has approved the plans for the modification to allow for parking in front of the Medical Office Building that is being constructed and has approved the legal descriptions for the right-of-way being conveyed and the portions of the existing sidewalks being granted. Accordingly, staff is recommending that Council accept the dedication of the Right-of-Way from Globe Land Investors LLC, approve the Partial Termination and Release of Easement, and authorize the city manager to execute both.
