SUMMARY
A Final Plat of Liberty Well Site 19B subdividing approximately 0.230 acres into one lot on the site located east of the southeast corner of West Sells Drive and North Sarival Avenue (the “Property”) .

RECOMMENDATION
Conditionally approve the Final Plat of Liberty Well Site 19B subdividing approximately 0.230 acres into one lot, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)
STIPULATIONS
1. All technical corrections to this final plat required by the City Engineer or designee shall be made prior to the recordation of the Final Plat of Liberty Well Site 19B;
2. Prior to recordation of the Final Plat, the property owner shall submit an updated title report for the property included within the Final Plat and shall modify the Final Plat to reflect the current ownership and current lender, including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so;
3. The owner shall disclose to all future purchasers and tenants that the property is subject to attendant noise, vibrations, dust, and all other effects that may be caused by overflight and by the operation of aircraft landing at, or taking off from, Luke Air Force Base and/or the Phoenix-Goodyear Airport. Such disclosure statement shall also be included in the Public Sales Report.

FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
On January 14, 2008, City Council approved the rezone for project 2006-200-00012, approving Ordinance No. 2007-1097 and effectively rezoning the property from Agricultural to Planned Area Development (PAD), with an underlying zoning of I-1, Light Industrial Park. On February 11, 2016, the Final Plat of “PV303 East – Phase A” was recorded in Book 1260 of Maps, Page 15 of the official records of Maricopa County. On October 16, 2023, the Development Services Department Director or designee, administratively authorized the subdivision of this property without the required Preliminary Plat for the proposed Liberty Well Site 19B.
STAFF ANALYSIS
This Final Plat proposes to split the existing Lot 5 within the “PV303 East – Phase A” subdivision into two lots, to facilitate the development of a public utility facility. The General Plan designates the subject property as ‘Industrial’. The ‘Industrial’ land use category provides for more intensive business and employment uses which have a greater impact on surrounding land uses. The existing zoning of PAD with an underlying zoning of I-1 is in conformance with the General Plan land use designation and this Final Plat is in conformance with the General Plan and zoning.
The Development Services Director or designee may waive the requirement for a preliminary plat for proposed subdivisions that will include 10 or fewer lots, tracts, or parcels if the proposed subdivision will be consistent with the zoning applicable to the subdivision, including compliance with the minimum size of each lot, tract and parcel required in the zoning applicable to the subdivision. If the requirement for a preliminary plat is waived, the subdivider may then proceed directly to the submission of a final plat and engineering plans.
As set forth above, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
