SUBJECT: PUBLIC HEARING TO CONSIDER THE PROPOSED LICENSING FEES AND PENALTIES TO LICENSED PROVIDERS OF THE GOODYEAR SHARED MOBILITY DEVICE PROGRAM

SUMMARY:

Hold a public hearing to consider the proposed licensing fees and penalties to licensed providers of the Goodyear Shared Mobility Device Program.

Recommendation:

ADOPT RESOLUTION NO. 2021-2149 APPROVING THE GOODYEAR SHARED MOBILITY DEVICE PROGRAM, ARTICLE 6 AND 7 FINANCIAL OBLIGATIONS, PENALTIES, FEES, AND OTHER FINANCIAL ASSURANCES. (Christine McMurdy, Project Management Coordinator)

FISCAL IMPACT:

There is no financial impact at this time, however, if or when a Shared Transportation Company (i.e. Bird, Lime, Spin, Scoot, etc.) applies and receives a temporary license to operate shared mobility devices within the City of Goodyear; said Goodyear Shared Mobility Device Program Article 6 and 7 financial obligations, penalties, fees, and other financial assurances may or may not cover the City’s cost to administer and enforce the program.

BACKGROUND AND PREVIOUS ACTIONS:

In November 2018, Council received a yellow paper which explained a new and growing transportation trend which includes dockless bicycles and electronic kick-scooters. The yellow paper also discussed how some Valley cities were adapting to these new trends. Subsequent to the yellow paper, on September 16, 2019, Council received a staff presentation during a Work Session and requested that the city create a Shared Mobility Device Program.

On December 19, 2019, the Mayor and Council adopted Ordinance 2019-1459 which established Goodyear City Code Chapter 13, Article 13-6 to provide for the regulation of single-rider Shared Mobility Devices, establish safety guidelines for protective equipment to minimize injury, and develop safety education for the operation of Shared Mobility Devices.

STAFF ANALYSIS

Pursuant to Goodyear City Code Chapter 13, Article 13-6, the Development Services Department completed a review of the available Shared Mobility Device Programs created by the cities of Scottsdale, Tempe, Gilbert and Phoenix and found that the Shared Mobility Device Program financial obligations, penalties, fees and other financial assurances varied greatly between these neighboring/nearby cities.  The Development Services Department staff, however, recommend that the Mayor and Council pass the attached Resolution No. 2021-2149 and approve the proposed Goodyear Shared Mobility Device Program Article 6 and 7 financial obligations, penalties, fees, and other financial assurances. These can be amended at a later date once the City has some experience administering and enforcing the Shared Mobility Device Program.
