SUBJECT: FINAL PLAT OF LA JOLLA VISTA - PHASE 1

SUMMARY

A Final Plat subdividing approximately 111.81 acres into 387 lots and 34 tracts on the north side of Lower Buckeye Road between Cotton Lane and Citrus Road.

STRATEGIC PLAN ALIGNMENT

     

RECOMMENDATION

Approve the Final Plat of La Jolla Vista – PHASE 1, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)

STIPULATIONS

1. This final plat shall not be recorded until Roosevelt Irrigation District and Maricopa County have approved the construction plans for the public infrastructure to be constructed within boundaries of the final plat;
 
2. Prior to recordation of this final plat, all technical corrections to this final plat required by the City Engineer or his designee shall be made; and

3. Prior to recordation of this final plat, Owner shall submit an updated title report for the property included within the boundaries of the Final Plat (the “Platted Property’) and shall modify the final plat to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the Platted Property. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing the Final Plat is authorized to do so; and

4. Prior to recordation of this final plat, the dedication of the tracts to the La Jolla Vista Community Association (HOA) shall be revised to reflect that tracts 1A through 1D inclusive, tracts 1F through 2F, inclusive, and tract 2H are being conveyed to the HOA; and
 
5. Prior to the recordation of this final plat the following note shall be added to the final plat:  "The La Jolla Community Association (HOA) shall ensure that all paths and trails within the Platted Property are cleared, visible, and safely accessible to all users, and the HOA shall maintain all landscaping within the street right-of-way within or abutting Platted Property except for landscaping within medians located within any arterial street."; and
 
6. No Certificate of Completion, Temporary Certificate of Completion or Certificate of Occupancy for any structure within the Platted Property except for model homes shall be issued until full half-street improvements for the north-half of the section of W. Lower Buckeye Road between 173rd Avenue and Citrus Road required for a Minor Arterial as set forth in the Engineering Design Standards in effect when the improvements are constructed, except for the construction of one-half (½) the median and one-half (½) the median landscaping, including, but not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting (the “Lower Buckeye Road Improvements”) have been completed.  The Lower Buckeye Road Improvements will be completed when accepted by the City Engineer of his designee subject to completion of the two-year warranty period; and
 
7. Unless already paid, prior to recordation of this final plat or the issuance of any construction permit for work within the Platted Property, whichever is earlier, Owner shall remit to the city an in-lieu payment for one-half the cost of a full median and one-half the cost of full-median landscaping for the median that is to be installed within the section of W. Lower Buckeye Road between 173rd Avenue and Citrus Road. The in-lieu payment for the median and landscaping shall be based on the actual cost of the improvements if previously completed by others or based on the estimated cost of the improvements as determined by the City Engineer or designee; and
 
8. No Certificate of Completion, Temporary Certificate of Completion or Certificate of Occupancy for any structure within the Platted Property except for model homes shall be issued until full half-street improvements for the west-half of the section of S. 173rd Avenue along or adjacent to the frontage of the Platted Property required for a Major Collector as set forth in the Engineering Design Standards in effect when the improvements are constructed, including, but not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting, and a full median from Lower Buckeye Road connecting into the existing median, which is approximately 100-feet north of the northern property line, have been completed (the “173rd Avenue Improvements”). The 173rd Avenue Improvements will be completed when accepted by the City Engineer of his designee subject to completion of the two-year warranty period.  (The City shall reimburse Owner the money the City collected from the adjacent property owner as a contribution towards the cost of the median and median landscaping); and
 
9. No Certificate of Completion, Temporary Certificate of Completion or Certificate of Occupancy for any structure within the Platted Property except for model homes shall be issued until full street improvements for the north half and the south half of the section of W. Magnolia Street required for a Local Street as set forth in the Engineering Design Standards in effect when the improvements are constructed, including, but not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting have been completed (the “Magnolia Street Improvements”). The Magnolia Street Improvements will be completed when accepted by the City Engineer of his designee subject to completion of the two-year warranty period; and
 
10. Unless already paid, prior to recordation of this final plat or the issuance of any construction permit for work within the Platted Property, whichever is earlier, Owner  shall remit the following payments to the City: 
  1. 25% of the cost of the full traffic signal (all four legs) at W. Lower Buckeye Road and S. 173rd Avenue.
  2. 50% of the cost of the full traffic signal (all four legs) at W. Lower Buckeye Road and S. 175th Avenue.
 
11. Unless already paid, prior to recordation of this final plat, Owner shall remit a cost recovery payment to the City in the amount of $496,220.16 for payments owed for regional wastewater lines B and E, which have been fully constructed, pursuant to the Cost Recovery Resolution 06-1065 as modified by Resolution 14-1622 and as further modified by Resolution 16-1748 (the “Wastewater CRO”); and
 
12. Unless already paid, prior to recordation of this final plat, Owner shall remit a cost recovery payment to the city in the amount of $198,333.00 for payments owed for regional water lines A and B, which have been fully constructed, pursuant to the Cost Recovery Resolution 06-1064 as modified by Resolution 14-1621 and as further modified by Resolution 16-1747 (the “Water CRO); and
 
13. No Certificate of Completion, Temporary Certificate of Completion or Certificate of Occupancy for any structure within the Platted Property except for model homes shall be issued until the Centralized Park Phase 1 Improvements described in Ordinance 2022-1545, have been substantially completed as determined by the City of Goodyear Building Official or his designee.  The Centralized Park Phase 1 Improvements include:
 
· splash pad with shaded seating;
· A restroom facility; and
· A minimum of two (2) Pickleball courts; and
· A basketball court; and
· A resort-style pool that includes at least one lap lane (may be contained within two pools); and
· A gas fire pit; and
· A game lawn with games such as cornhole, bocce ball, or the like;
· A ramada with shade and a barbeque grill; and
· Shaded or trellised seating areas; and
· A shaded tot lot
 
14. Unless already completed, prior to recordation of this final plat or the issuance of any construction for work within the Property, Owner shall apply to the Arizona Department of Water Resources (ADWR) for the extinguishment of the Type 1 Rights appurtenant to the Property and request that any assured water supply credits issued by ADWR as a result of any such extinguishment be credited to the City of Goodyear.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

On October 24, 2022, the City adopted Ordinance No. 2022-1545 and the associated Map 21-17 with Case Number 21-200-00017, to effectively rezone the property from the previous PAD zoning to the current R1-6 with PAD Overlay and R1-4 with PAD Overlay.

On February 3,2023, after determining that the preliminary plat complied with public objectives, subdivision design principles and standards, and streets and thoroughfare planning and the reports and studies submitted in support of the preliminary plat demonstrated the adequacy of utilities, open space and other public facilities needed to serve the development, staff administratively approved the Preliminary Plat for the site with stipulations, under Case Number 21-500-00014. This final plat covers Phase 1 of the development and consists of approximately 111.81 acres of the approximately 201.01 total acres for La Jolla Vista.

STAFF ANALYSIS

The proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development. The Final Plat is in substantial conformance with the Preliminary Plat.
