SUBJECT: MAP OF DEDICATION FOR SECTIONS OF GOODYEAR BOULEVARD

SUMMARY

A Map of Dedication dedicating 0.930 acres of right-of-way (ROW) for a section of W. Goodyear Boulevard North and S. Goodyear Boulevard East required for the construction of the improvements to sections of Goodyear Boulevard by the developer of the adjacent multi-family residential project generally located at the northwest corner of W. Yuma Road and S. Goodyear Boulevard East.

RECOMMENDATION

Conditionally approve the Map of Dedication for sections of Goodyear Boulevard, of approximately 0.930 acres of right-of-way (ROW), subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)

STIPULATIONS

1. All technical corrections to this MOD required by the City Engineer, or designee, shall be made prior to the recordation of this MOD; and,
2. Prior to recordation of this MOD, the property owner shall submit an updated title commitment for the property included within this MOD to reflect the current ownership and current lender including on this MOD a Lender Consent and Subordination in a form approved by the City Attorney, or designee, for all lenders with a security interest in the property being dedicated herein. Owner shall provide documentation acceptable to the City Attorney, or designee, demonstrating that the party executing this MOD is authorized to do so; and
3. The owner shall disclose to all future purchasers and tenants that the property is subject to attendant noise, vibrations, dust, and all other effects that may be caused by overflight and by the operation of aircraft landing at, or taking off from, Luke Air Force Base and/or the Phoenix-Goodyear Airport. Such disclosure statement shall also be included in the Public Sales Report.

FISCAL IMPACT

The right-of-way being dedicated is being dedicated in support of the development of the multi-family residential project known as Ballpark Village North generally located at the northwest corner of W. Yuma Road and S. Goodyear Blvd. East (the “Property”).  Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The right-of-way being dedicated to the City is being dedicated in support of the development of a multi-family development project known as Ballpark Village North. The Property was rezoned on May 22, 2022, per Ordinance No. 2022-1538 and Resolution No. 2022-2233. On February 15, 2023, the Planning & Zoning Division administratively approved the Master Site Plan, per Planning Case No. 22-600-00034.

STAFF ANALYSIS

The approval of this MOD will provide the city with the additional right-of-way needed for the developer of the multi-family residential project currently known as Ballpark Village North to complete the construction of the half-street improvements to the sections of Goodyear Blvd adjacent to the Property. The right-of-way width and road alignment established with this map of dedication (MOD) is consistent with the City of Goodyear Transportation Master Plan and with the technical requirements of the city’s engineering standards.
