SUMMARY
A Final Plat to replat six lots, a portion of a seventh lot, and one tract into nine lots and one tract comprising a total of 122.024 acres located at the northwest corner of the intersection of North Bullard Avenue and West McDowell Road .

RECOMMENDATION
Conditionally approve the Final Plat for Goodyear Regional Center, to replat six lots, a portion of a seventh lot, and one tract into nine lots and one tract comprising a total of 122.024 acres, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering).
STIPULATIONS
1. Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat; and
2. Prior to recordation of the Final Plat, Owner shall submit a current title commitment for the property and shall modify this plat to reflect the current ownership and current lender, including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the Property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the persons executing this final plat are authorized to do so; and
3. Prior to recordation of the Final Plat, Owner shall revise the dedication section with the current ownership name of the Final Plat and to include the revisions reflected in the Dedication Statement attached as an exhibit to this CAR; and
4. Prior to recordation of the Final Plat, Owner shall make the following changes to the City of Goodyear General Notes for Final Plat, located on Sheet 2 of 5; and
a. Note D. Replace the first paragraph of Note D with the following: Public improvements constructed within the Public Access and Utility Easements conveyed to the City in this final plat shall be maintained by the owner of the property within which the easements are located or a property owner’s association as reflected in the dedication of the Public Access and Utility Easements herein. Public Improvements made within the streets conveyed to the City in fee in this final plat that will be maintained by the City shall be clearly identified on the approved plans. The public improvements may include, but are not limited to street surfaces, curbs, gutters, sidewalks, ramps, driveways, turn bays, bus bays, street lighting signage, and street striping. All public improvements are subject to the requirements set forth in clauses 1-3 below. (rest of this note (1-3) can remain as is.); and
b. Note G. Replace Note G with the following: Facilities associated with storm water management constructed within Public Access and Utility Easements conveyed to the City in this final plat shall be maintained by the owner of the property within which the easements are located or a property owner’s association as reflected in the dedication of the Public Access and Utility Easements herein. In addition, each owner of property subject to this final plat shall be responsible for the proper maintenance and repair of all other facilities associated with stormwater management constructed on such owner’s property; and
c. Note J. Delete the following language at the end of this note: “or as otherwise later agreed upon by the City”; and
d. Note K. Delete this note; and
e. Note L. Replace Note L with the following: Public improvements constructed within the Exclusive Public Access and Utility Easements and the Exclusive Public Utility and Sidewalk Easements conveyed to the City in this final plat shall be maintained by the owners of the property within which the easements are located or a property owner’s association as reflected in the dedications of the Exclusive Public Access and Utility Easements and Exclusive Public Utility and Sidewalk Easements herein; and
f. Note M. Delete this note; and
5. Prior to recordation of the Final Plat, Owner shall (i) form a Property Owner’s Association (“POA”); (ii) adopt and record CC&Rs that provide for the POA’s maintenance of the public improvements and storm water facilities located within the Public Access and Utility Easements and the public sidewalks constructed within the Public Utility and Sidewalk Easements, which CC&Rs are subject to approval by the City Attorney or his designee, and (iii) modify the Final Plat to include language pursuant to which the POA agrees to accept responsibility for maintaining the public improvements and storm water facilities located within the Public Access and Utility Easements and the public sidewalks constructed within the Public Utility and Sidewalk Easements.

FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
On February 27, 2023, the Property was rezoned from Planned Area Development (PAD) to a PAD entitled GSQ Regional Center by Ordinance No. 2023-1561. The Supplemental Design Guidelines for GSQ Regional Center were administratively approved by the Development Plan Review team on August 16, 2023.
Per Section 15-2-3(C)(2) of the City of Goodyear Subdivision Ordinance, this project does not require a Preliminary Plat since it involves ten or fewer lots.

STAFF ANALYSIS
The proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
