SUBJECT: FINAL PLAT OF ASCENT AT CANYON TRAILS

SUMMARY

A Final Plat of Ascent at Canyon Trails subdividing approximately 7.84 acres into 113 lots and 7 tracts at the southeast corner of the intersection of W. Roosevelt Street and N. 158th Avenue.

RECOMMENDATION

Conditionally approve the Final Plat of Ascent at Canyon Trails, subdividing approximately 7.84 acres into 113 lots and 7 tracts, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)

STIPULATIONS

1. All technical corrections to this final plat required by the City Engineer or designee shall be made prior to the recordation of the Final Plat of Ascent at Canyon Trails;
2. Prior to recordation of the Final Plat, the property owner shall submit an updated title report for the property included within the Final Plat and shall modify the Final Plat to reflect the current ownership and current lender, including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so;
3. The owner shall disclose to all future purchasers and tenants that the property is subject to attendant noise, vibrations, dust, and all other effects that may be caused by overflight and by the operation of aircraft landing at, or taking off from, Luke Air Force Base and/or the Phoenix-Goodyear Airport. Such disclosure statement shall also be included in the Public Sales Report.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the city. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the city through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The site was part of the original Planned Area Development (PAD) for Canyon Trails Phase 1, which was approved in preliminary form by City Council on September 14, 1998, and in final form on July 26, 1999.  Per this original PAD, the site was designated for townhomes. The PAD was later amended on March 28, 2011, to switch the designated use to commercial.

On January 23, 2023, City Council approved a Rezone of the site from PAD allowing neighborhood commercial uses, to Single Family Attached (R1-A) with a PAD Overlay, per Ordinance 2023-1566. On September 22, 2023, a preliminary plat was approved by the Development Services Director for a development of 113 townhomes on the site, to be known as Ascent at Canyon Trails.

STAFF ANALYSIS

The proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development. The Final Plat is in substantial conformance with the Preliminary Plat.
