SUBJECT: DELEGATION OF AUTHORITY TO THE CITY MANAGER OR DESIGNEE TO AUTHORIZE TERMINATIONS OF EASEMENTS

SUMMARY

Adoption of the proposed Resolution will authorize the delegation of authority to the City Manager or designee to terminate easements that are no longer needed pursuant to state law.

RECOMMENDATION

ADOPT RESOLUTION NO. 2024-2433 AUTHORIZING THE CITY MANAGER TO APPROVE AND EXECUTE DOCUMENTS TERMINATING CERTAIN EASEMENTS PREVIOUSLY CONVEYED OR ACQUIRED BY THE CITY AND PROVIDING AN EFFECTIVE DATE. (Christian Williams, Planning Manager)

FISCAL IMPACT

The proposed changes are revenue-neutral. No additional costs or other financial obligations are incurred as a result of the delegation of authority.

BACKGROUND AND PREVIOUS ACTIONS

Pursuant to A.R.S. § 9-402, a city or town may convey to the appropriate property owner without receiving payment an easement that the city or town no longer needs. The city of Goodyear has adopted subdivision regulations which have been amended to allow the approval of preliminary plats to be approved administratively without council approval. A work session with the City Council was held on July 1, 2024 in which staff presented Council with information on process improvements proposed within the Development Services Department. One of the proposed improvements involved the administrative approval of final plats and Council directed staff to proceed with the process improvement. Staff is also seeking termination of easements to be delegated to the City Manager or designee after a written determination by the City Engineer or his/her designee that the easement is no longer needed, and a written determination by city real estate staff that a clearance process has been completed to determine no public utility companies and/or any other entities that have licenses, franchise agreements, and/or any other agreements with the city have been allowed to construct improvements within the public utility easements and/or other city easements being terminated.

STAFF ANALYSIS

Staff is proposing the City Council authorize the delegation of authority to the City Manager or designee for the termination of easements that are no longer needed pursuant to state law.
