SUBJECT: AMENDMENT TO LOT 19 OF THE PALM VALLEY CROSSING PLANNED AREA DEVELOPMENT

SUMMARY

This request is to amend the Palm Valley Crossing Planned Area Development (PAD) to allow an indoor gun range as a permitted use on Lot 19 of the PAD located at the northwest corner of Auto Drive and 137th Avenue. The amendment will only apply to Lot 19, as established within the PAD and Palm Valley Crossing final plat.

Recommendation

1. ADOPT RESOLUTION NO. 2021-2171 - A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, DECLARING A PUBLIC RECORD THAT CERTAIN DOCUMENT FILED WITH THE CITY CLERK AND TITLED: “OFFICIAL SUPPLEMENTARY ZONING MAP NO. 21-11”.

2. ADOPT ORDINANCE NO. 2021-1510 - AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, CONDITIONALLY AMENDING THE PALM VALLEY CROSSING PLANNED AREA DEVELOPMENT DATED DECEMBER 2006 TO ALLOW AN INDOOR GUN RANGE AS A PERMITTED USE ON LOT 19; AMENDING THE ZONING MAP; AND PROVIDING FOR NON-ABRIDGEMENT, CORRECTIONS, SEVERABILITY, PENALTIES AND AN EFFECTIVE DATE. FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the city. The development is responsible for construction of infrastructure necessary to serve the site and will generate one-time revenue for the city through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The subject property (Property) pursuant to this request is designated as Business & Commerce in the General Plan Land Use and Transportation Plan. This land use designation is intended for uses such as community level retail, entertainment, regional service oriented businesses, business parks, warehousing and other light industrial uses.

The Property is zoned PAD (Planned Area Development), with the PAD known as Palm Valley Crossing. The PAD is a regional commercial development generally located at the southeast corner of I-10 and Litchfield Road. Automotive, retail and service uses are permitted within the Palm Valley Crossing PAD. Pursuant to the PAD, the Property is designated with the Automotive Related Commercial and Service Commercial/Commerce (ARC/SC) land use categories.

A history of the Palm Valley Crossing PAD, as related to the subject request, is provided below:
  • The zoning for the development was initially approved on March 28, 1995 with City Council adoption of Ordinance No. 95-523. At time of adoption, the PAD was known as the Palm Valley Metroplex.
  • A final plat for Palm Valley Crossing (formerly known as Palm Valley Metroplex) was approved by the City Council on September 10, 1996 (MCR 96-0695705). The Property was established as Lot 19 of the final plat.
  • A site plan for the Goodyear Business Center (Lot 19) was approved on November 29, 2006. Development included three buildings and associated parking, landscaping and utilities on the 4.5-acre lot.
  • An amendment to the PAD (now known as Palm Valley Crossing) was approved by the City Council on February 12, 2007 with the adoption of Ordinance No. 07-1058. This amendment modified the development standards and permitted uses for a 66-acre portion of the PAD. As specifically established in the amendment, ‘Guns – wholesale and retail sales’ were listed as a permitted use in the Service Commercial/Commerce (SC) land use category. The Property (Lot 19) was included in this amendment and designated as Automotive and Related Commercial and Service Commercial/Commerce (ARC/SC).
  • The PAD was further amended by the City Council on July 11, 2011 with the adoption of Ordinance No. 11-1244. The amendment revised the permitted uses for an approximately 55-acre portion of the PAD generally located adjacent to I-10 (Lots 1-5, 11, 15 & 16 of the final plat) but did not include the Property (Lot 19). As amended, ‘Guns – wholesale, retail sales, and gun range’ were established as a permitted use, among other changes. Again, it should be noted that the amendment did not include the Property. As such, while the wholesale and retail sale of guns would be permitted on the Property, a gun range would not be permitted.

STAFF ANALYSIS

Current Policy:
An amendment to a PAD requires review by the Planning and Zoning Commission and final decision by the City Council through the public hearing process. The amendment must be in conformance with the General Plan and should not adversely impact the surrounding area as outlined in the Zoning Ordinance.

Details of the Request:
The request is to allow an indoor gun range as a permitted use on Lot 19 of the Palm Valley Crossing PAD. Lot 19 consists of 4.54 acres. The Property is developed. Development includes three buildings and associated landscaping, parking and utilities.

Other than the amendment to allow an indoor gun range on Lot 19, no other amendments, modifications, or changes to existing permitted uses are proposed to the Palm Valley Crossing PAD. As such, given the limited scope of this request, no departmental or functional impacts are anticipated and therefore not addressed in this staff report.

Findings:
Staff finds the request to allow an indoor gun range as a permitted use on Lot 19 to be in conformance with the General Plan. As previously noted, the Property is located within an area intended for business and commerce use by the General Plan. An indoor gun range can be considered as an appropriate use in a commercial zone and complementary to sale of firearms, which is already permitted by right in the Palm Valley Crossing PAD. Allowing an indoor gun range on Lot 19 is consistent with the uses permitted on a significant portion of the PAD, including the adjoining Lot 15 to the north of the Property.

Staff further finds allowing an indoor gun range on Lot 19 as a permitted use, subject to the stipulations set forth in Ordinance 2021-1510, will not adversely impact the surrounding area as the use will occur indoors, within a fully enclosed building. Additionally, the Property is located within an area developed with existing commercial and light industrial uses, with similar characteristics related to traffic, noise and lighting, among others. And, as noted above, an indoor gun range is already a permitted use within a large segment of the PAD. Regarding nearby residential uses, there are no adjacent residential developments to be adversely affected by this commercial use, with the nearest residential development located approximately 1,300 feet to the south (multi-family) and 1,400 feet to the east (single family). Given this distance from the Property, these developments should not be adversely affected by the proposed use of the Property for an indoor gun range.

Planning and Zoning Commission:
The Planning and Zoning Commission considered this item at a public hearing held on July 7, 2021. After a presentation from staff, Commissioner Molony asked what size the building is. Staff state 36,000 square feet. Shaine Alleman, representing the applicant, stated that Shooter’s World is excited to open in Goodyear. This will be the location of their headquarters. Upon closure of the public hearing, the Commission unanimously voted (6-0) to forward a recommendation of approval to the City Council. There was no public opposition to this item voiced at the hearing.
