SUMMARY

Andrea Lewkowitz, Agent for Postino, has submitted an application to the Arizona Department of Liquor Licenses and Control for the transfer of ownership of an existing Series 7 Beer and Wine Bar License and request for a new Series 12 Restaurant Liquor License for the location at 1800 N. Bullard Avenue, Goodyear, AZ 85395. The applicant is requesting that the city forward a recommendation of approval to the Arizona Department of Liquor Licenses and Control (DLLC) for consideration and issuance of the license.

FISCAL IMPACT

In compliance with the Goodyear Municipal User Fee Schedule, the applicant submitted the required $635 administrative application fee.

BACKGROUND AND PREVIOUS ACTIONS

The City Clerk’s Office received a Series 12 (Restaurant) liquor license application and a Series 7 Beer and Wine Bar license transfer application on June 11, 2026, from the Arizona Department of Liquor Licenses and Control (DLLC) for Postino Goodyear, represented by Agent Andrea Lewkowitz. The request includes the transfer of an existing Series 7 Beer and Wine Bar License (Liquor License No. 07070399), including ownership and location, as well as the issuance of a new Series 12 Restaurant Liquor License. The Series 7 transfer would authorize the new owner to continue beer and wine sales at the proposed location under the transferred license. The Series 12 license would authorize the establishment to operate as a restaurant and sell spirituous liquor for on-premises consumption in accordance with state law.

In accordance with A.R.S. §4-201(B), the public hearing notice was posted at the establishment on June 16, 2026, for the required 20-day period. This public posting allows individuals within a one-mile radius to submit written arguments for or against the issuance of the license. No public petitions or protests were received during the posting period. The application underwent internal review by the Police Department and Development Services Department, including Code Compliance, Building and Planning & Zoning, with no objections reported. The application is included as Attachment A - DLLC Local Governing Body Report.

STAFF ANALYSIS

The requested Series 12 Restaurant License is a non-transferable license issued to establishments that operate primarily as restaurants. The license authorizes the sale of all types of spirituous liquor for consumption on the premises, provided that at least 40% of the establishment's gross revenue is derived from food sales.

State regulations (A.R.S. §4-207) prohibit liquor licenses within 300 feet of licensed childcare facilities or K-12 schools. The proposed location complies with this requirement. A One-Mile Report and Evaluation Map is included as Attachment B and identifies existing liquor licenses and three K-12 school within that radius.

DLLC requires owners, agents, managers involved in daily operations to complete state-approved management training. The applicant has confirmed that the owner and manager have completed the Title 4 Basic and Management Training. Operationally, a manager will be onsite during operating hours, staff will monitor alcohol consumption, and identification will be required for patrons who appear to be under the legal drinking age.

Based on staff's review, the application materials satisfy the statutory requirements for consideration by the DLLC. The City Council's recommendation will be forwarded to the DLLC for consideration as part of its final licensing determination.
