SUMMARY
A Final Plat of PV303 West II – Phase 2 subdividing approximately 106.77 acres into 5 lots at the intersection of South Cotton Lane and West Thomas Road .
Recommendation
Approve the Final Plat of PV303 West II – Phase 2 (the “Final Plat”) subdividing 106.77 acres into 5 lots generally located at the intersection of South Cotton Lane and West Thomas Road, subject to stipulations. (Christopher Baker, Development Services Director)
STIPULATIONS
- Prior to recordation of the Final Plat all technical corrections to the Final Plat required by the City Engineer shall be made.
- Owner shall provide a completed Storm Water Maintenance Agreement (SWMA) to be approved and recorded by the City prior to the issuance of the final grading & drainage construction permits.
- Prior to recordation of the Final Plat, a current title report for the property included within the Final Plat (the “PV303 West II – Phase 2 Property”) shall be submitted to the city and the Final Plat shall be modified as needed to reflect the current ownership and current lender including on the Final Plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the PV303 West II – Phase 2 Property. The property owner(s) shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing the Final Plat is authorized to do so.
- Prior to recordation of the Final Plat, and assuming there has been no change in ownership, the signature block(s) on the Final Plat for the property owner(s) shall be revised as needed to reflect the management structure of the limited liability companies and property owner(s) shall provide documentation satisfactory, to the City Attorney or his designee, establishing he/she has the authority to bind the property owner on whose behalf he/she is signing the final plat.
- Prior to recordation of this Final Plat, the property owner shall record the 16-ft water easement identified in this Final Plat and insert the recording information into the Final Plat.
- Prior to recordation of the Final Plat, the property owner shall record the 50-ft private access easement identified in this Final Plat that provides access to Lots 2, 3,4,5 and shall insert the recording information into the Final Plat.
- Prior to recordation of the Final Plat, the property owner shall record the private access easement through Lot 4 identified in this Final Plat that provides access to Lot 6 and shall insert the recording information into the Final Plat.
- Prior to recordation of the Final Plat, property owner shall record all of the other easements identified referred to in this Final Plat and shall insert the recording information into the Final Plat.
- Prior to recordation of the Final Plat, an in-lieu payment in the amount of $145,000 shall be remitted to the City of Goodyear, which represents 25% of the estimated cost of a full traffic signal (all four legs) at the intersection of Cotton and Thomas Road.
- Prior to recordation of the final plat, an in-lieu payment in the amount of $280,000 shall be remitted to the City of Goodyear, which represents 50% of the estimated cost of a full traffic signal (all four legs) at the intersection of Cotton and Osborn Road.
FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
The subject property is a part of the PV303 Planned Area Development (PAD). The PV303 was last amended on June 25, 2018, with City Council adoption of Ordinance No. 2018-1391. The preliminary plat of PV303 West II was approved by the City Council on December 17, 2018 .
STAFF ANALYSIS
As set forth in the attached preliminary plat Council Action Report, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is in substantial conformance with the preliminary plat , and, as set forth in the council action report for the preliminary plat attached hereto, is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
