SUBJECT: AGREEMENT WITH BUCKEYE WATER CONSERVATION AND DRAINAGE DISTRICT (BWCDD) FOR REPAIR AND IMPROVEMENTS TO THE BULLARD WASH OUTFALL

SUMMARY

The proposed Agreement with Buckeye Water Conservation and Drainage District (BWCDD) will allow for structural repairs and improvements to the Bullard Wash Outfall for an amount not to exceed $1,360,756.01.

Recommendation

Approve the Agreement with the Buckeye Water Conservation and Drainage District for repairs and improvements to the Bullard Wash Outfall and the expenditure of funds to meet the terms of the Agreement. (Barbara Chappell, Deputy Public Works Director)

FISCAL IMPACT

This Agreement will repair the canal banks, the outfall structure, and provide a walkway for inspection of the structure for an amount not to exceed $1,360,756.01.  The project was approved in the FY2022 Capital Improvement Plan and funds in the amount of $1,800,000 are available in the Bullard Wash Outfall Repairs CIP Project (60073).  Although eligible for ARPA funding, this project will be funded as originally intended utilizing general funds due to the required timing of the project and the complexities of federal funding associated with the BWCDD (another governmental agency) involved in the process.

BACKGROUND AND PREVIOUS ACTIONS

In April 1998, the city entered into an Intergovernmental Agreement (IGA) with the Maricopa County Flood Control District to share in the cost of construction of the Bullard Wash Outfall. The IGA further assigned the responsibility to inspect and maintain the completed project to the city.

The concrete structure that allows stormwater flows from Bullard Wash to cross over the BWCDD canal seems to have questionable design that restricts the water flow in the canal, and this Bullard Wash concrete structure has been undermined by erosion of the canal's earthen banks possibly caused by the design of the concrete structure and/or caused by past flooding events.

STAFF ANALYSIS

The BWCDD has a planned canal dry up for November 2021 for maintenance.  We have contracted them to include the repairs to this outfall during this time.  In order to facilitate the work on the canal, staff has worked with BWCDD to develop the scope for the design and construction of the repairs.

The current outfall configuration makes it difficult to inspect the south side of the structure.  Staff has worked with BWCDD to have a walkway added to the edge of the structure so that this can occur even during wet weather events.
