SUBJECT: RATIFICATION OF THE THIRD AMENDMENT TO CITY OF PHOENIX INTERGOVERNMENTAL AGREEMENT FOR SHARED TELECOMMUNICATIONS FACILITIES

SUMMARY

Request to ratify the execution of the Third Amendment to the City of Phoenix Intergovernmental Agreement (IGA) for shared telecommunications facilities to extend the agreement for another ten years through May 10, 2030.

Recommendation

ADOPT RESOLUTION NO. 2021-2180 APPROVING THE THIRD AMENDMENT OF INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF PHOENIX FOR CONTINUED SHARED TELECOMMUNICATION FACILITIES, AND PROVIDING FOR AUTHORIZATION AND RATIFICATION. (Santiago Rodriguez, Chief of Police)

FISCAL IMPACT

There is no fiscal impact for the FY2022 or future years with the approval of this IGA.

BACKGROUND AND PREVIOUS ACTIONS

In May 1995, Goodyear City Council authorized the first Intergovernmental Agreement (IGA) between the City of Phoenix and the City of Goodyear for shared use of telecommunication facilities.
 
The IGA was for an initial term of five years, with the option of future ten-year extensions. Council subsequently approved ten-year extensions of the IGA on May 22, 2000 for the First Amendment and June 28, 2010 for the Second Amendment. The Second Amendment extended the IGA through May 10, 2020.

STAFF ANALYSIS

The City of Goodyear continues to utilize dispatching services and radio equipment shared with the City of Phoenix and intends to continue to utilize telecommunication facilities.  When the Second Amendment to the IGA expired on May 10, 2020, the Third Amendment document was signed and executed by both parties extending the IGA term for another 10-year term and was made effective May 11, 2020.  The execution of the Third Amendment required council approval but was erroneously approved administratively.
 
Staff is seeking to ratify the Third Amendment to the IGA, attached as Exhibit ‘A’ to this Resolution, which will authorize the extension of the agreement through May 10, 2030 and allow for one ten-year option to renew through May 10, 2040.
