SUMMARY
The action before the Council is to approve the Minor Land Division of Properties on Pico Drive attached hereto and to approve the expenditure authority for construction of the Western Avenue parking lot (CIP Project #42042).
Recommendation
Approve the Minor Land Division of Properties on Pico Drive and authorize its recordation with the Maricopa County Recorder and approve the expenditure authority of $1,533,400 for all fees and costs for design, construction, and equipment for the Western Avenue parking lot. FISCAL IMPACT
On October 25, 2021, Council authorized the required budget transfers for the creation of the project in the amount of $1.9 million. The adopted FY2023 budget for this project is
$1,533,400. Staff is requesting expenditure authority in the amount of $1,533,400 which includes $115,900 in encumbrances and $32,800 in actuals.

BACKGROUND AND PREVIOUS ACTIONS
The city owns certain property generally located at the northeast corner of Litchfield Road and Western Avenue that formerly housed municipal facilities. Although the property consists of multiple parcels, it was developed as a single lot with three buildings.
At the Work Session of July 12, 2021, Council directed staff to create a $1.9M Capital Improvement Program (CIP) project for inclusion in the FY2023 budget, to pursue option two, which is to raze the buildings, create parking and add green space to the city owned properties located at the northeast corner of Western Avenue and Litchfield Road.
On October 25, 2021, Council approved a budget transfer for the revised Western CIP Project in the amount of $1.9M to be funded in FY2022 for demolition of the buildings and creation of a parking lot.

STAFF ANALYSIS
The buildings were demolished on site in April 2022. Since then, designs have been developed, an artist has been selected, and the city has procured a general contractor to construct the parking facility.
The Minor Land Division of Properties on Pico Drive attached hereto (the “MLD”) is needed to effectuate Council’s vision for the property at northeast corner of Litchfield Road and Western Avenue that formerly housed municipal facilities. This MLD creates one legal lot and one tract from all the various parcels the city had acquired over time. The tract created by the MLD declares the tract as a public street, which is consistent with its existing use.
The original project completion was scheduled in December 2022. The project is behind schedule for the following reasons: 1) findings in the field led to delays completing demolition; 2) change in general contractor; 3) supply chain issues related to procuring electrical equipment. Substantial completion of construction is now anticipated to be in August 2023.
