SUMMARY

The applicant is requesting recommendation of approval for a New Series 12 (Restaurant) liquor license.

Recommendation

Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of Application No. 189744, a request by Ryan Witner Anderson, agent/applicant for Chuck E Cheese # 3222, for a new Series 12 liquor license. Chuck E Cheese #3222 is located at 13371 W. McDowell Rd., Goodyear, AZ 85395 generally located at the 13300 block of West McDowell Road. (Darcie McCracken, City Clerk)

FISCAL IMPACT

The applicant paid the $635 application fee for the liquor license per the Goodyear Municipal User Fee Schedule. The business will also contribute to the tax base of the community.

BACKGROUND AND PREVIOUS ACTIONS

Mr. Anderson has applied for a new Series 12 liquor license for Chuck E Cheese #3222 which is currently open for business but is not selling alcohol. Chuck E Cheese #3222 is a corporate operated location and is not a franchised location.

The City Clerk's Office received the application from the DLLC on April 11, 2022. A public notice was posted on the property on April 14, 2022, to comply with Arizona Revised Statutes §4-201(b). The applicant paid the $635 application fee for the liquor license. No petitions or protests from qualified persons were received during the comment period.

STAFF ANALYSIS

A Series 12 license is for a restaurant and is non-transferrable. This on-sale retail privileges liquor license allows the holder to sell and serve all types of spirituous liquor solely for consumption on the premises of an establishment that derives at least forty percent (40%) of its gross revenue from the sale of food. The applicant has noted that other Chuck E. Cheese locations operating in Arizona generate usually greater than 95% food sales, and generally less than 5% in alcohol sales.

The DLLC requires license owners, agents and managers actively involved in the day-to-day operations of the business to complete a state-approved management training course prior to the issuance of a liquor license. The applicant has provided that a trained manager will be working at the site before they begin selling alcohol, and additional sub-managers and staff selling/serving alcohol will also receive liquor training.
